Toilet breaks during class time

We're waiting for Shaun douglas to read recent responses and update the status.

Dear Department of Education,
May you be well.

Recently my daughter wet herself during class, after her teacher refused her access to the toilet. Apparently the primary school my 3 children attend has banned children from access to the toilet during class time.

Can you please send me any legal government policies, procedures or documents regarding children's health, safety and welfare (including mental health) and access to the toilet when they need to go during class time.

of Education (Department) on 13 November 2025, for access under the
Freedom of Information Act 1982 (FOI Act) to the following:

 

“…any legal government policies, procedures or documents regarding
children's health, safety and welfare (including mental health) and access
to the toilet when they need to go during class time.”

 

We have interpreted your request to be for government policies, procedures
or documents concerning children's health, safety and welfare (including
mental health), as well as access to the toilet during class time, as
applicable to the relevant school and/or state or territory where your
daughter attends school.

 

The Department is not responsible for the day-to-day administration and
management of schools.

 

Given the details of your request, it appears more appropriate for your
request to be directed to the education department in the relevant state
or territory where your daughter attends school. For example:

• if she attends school in Victoria, your request should be directed to
the [1]Victorian Department of Education, or
• if she attends school in Western Australia (WA), your request should
be directed to the [2]Department of Education WA.

 

Information on how to make a FOI request to a state or territory education
department can be found on their respective websites. We have included
some example links above if it assists. 

 

As it appears your request would be more appropriately handled by the
education department in the state or territory where your daughter attends
school, the department will treat your FOI request as withdrawn and take
