Dear FOI Team,
I refer to your letter dated 5th December, 2025 in which you claim that a practical refusal request exists in relation to my FOI request 2025000177.
First I note that you have provided incorrect information in that the request was received by the University on 6th August, 2025, not 6th October, 2025 as you claim. I assume this is merely an error caused by a copy and paste of this letter from another request, but I would ask that you take more care in legal documents such as this letter.
Given the correct timeframe, the University has had four months to process this request. To claim that a practical refusal reason exists on the basis of time to process the request when it is already multiple months overdue is on the face of it completely unreasonable.
I note that the number of FOI requests that are currently active is not a reason for a practical refusal. It is expected that the agency will provide sufficient resources to meet the objectives of the FOI Act. I note that the documents requested are all of significant public interest and this should be taken into account in any decisions (s3.201 of the FOI Guidelines from the OAIC).
You claim that assessing pages for release by the FOI team will take 10 minutes per page, without any basis for doubling the time based on your other practical refusal notices. Changing this to the 5 minutes per page that you have routinely claimed at other times removes at least 9 hours from your claimed times.
As I am sure you're aware, under s24AB(3) of the Act you must take reasonable steps to assist in the revision of the request to remove the practical refusal reason. Unfortunately your only recommended action is "increase precision" when I have already identified 5 documents explicitly. If you provide further information such as the length of the documents matching each of the agenda items to assist in further narrowing the scope I would be happy to assist you further.
I also note that your practical refusal notice does not appear to be valid under s24AB of the Freedom of Information Act 1982 (the Act). The notice does not set out a contact person as required under s24AB(2)(c) of the Act and instead suggests that I contact "[the FOI] office" using a generic email address. This has previously been found by the Australian Information Commissioner to be insufficient for the purposes of the Act.
Additionally, your notice suggests that the request could be treated as withdrawn if no response was received. I draw your attention to section 3.229 of the FOI Guidelines issued by the OAIC which explicitly notes that this is not possible when the agency has already exceeded the statutory timeline.
