The Department of Industry, Science, Energy and Resources (the department)
has received your Freedom of Information request of 17 March 2021
(attached).

 

I am writing on behalf of the department to acknowledge receipt of your

Currently, a decision is due to you by 16 April 2021. However, this
timeline may be affected by the requirement to undertake consultation with
affected third parties, or if the department determines you are liable to
pay a charge in relation to your request. You will be notified by the
department if charges are liable or if a third party consultation is
required.

 

Confirmation of Scope - personal information

 

For documents that fall within the scope of the request, it is the
practice of the department to withhold:

o the names, signatures and contact details of junior staff; that is:

o Commonwealth staff who are not in the Senior Executive Service
(SES); and
o Ministerial staff below the level of Chief of Staff; and

o the mobile phone numbers of SES officers.

 

The names and other details of SES officers will be released unless the
information is exempt from disclosure.

 

Confirmation from you that you are not seeking other 'personal
information' (i.e. contact details of any individuals, or any information
that could reasonably identify an individual) may enable a more timely and
cost effective processing of your request.

 

Therefore, could you please confirm if you are happy to exclude personal
information in the documents relating to:

 

o Commonwealth staff; and
o third party individuals.

 

If you are seeking access to specific types of personal information, could
you please specify. If you are not seeking access to any personal
information, you can simply reply to this email with 'no personal
information requested'.

Dear Sasha,

I did not ask for all 90 pages from the 15 Documents.

(Please understand I am using capitals here for emphasis as there is no bold/underline text formating on right to know website...)

I asked for ONLY the FIRST page of the CHECKLIST of each INELIGIBLE application (1 page from each of the 15 Documents you had found; just 15 pages in total).

I also asked that EVERYTHING except the "TICKS" (the checkboxes) be EXCLUDED, so:
- NO third-party information is involved,
- NO personal information,
- NO dates,
- NO application/project number,
- NO organisation,
- NO project title,
- NO comments...
- NOTHING except the TICKS - so it is possible to see how these anonymous ineligible applications were classified but impossible to identify any person nor any business.

In case I misunderstood and there are more than 15 applications, then please narrow the search to the timespan from 1/8/2016 to 31/12/2019.

To be clear, you can see what the 1st page of the requested checklists looks like on THE 14th PAGE of the 32 pages in this PDF here:

PLEASE ALSO NOTE this from my request too:
I only wish to see PAGE 1 of applications marked INELIGIBLE on PAGE 5
- meaning NOT applications marked as JUST INCOMPLETE on PAGE 5
- the applications must be marked INELIGIBLE on PAGE 5 of the checklists
- if an application is both INELIGIBLE and INCOMPLETE that's also a match as it's still INELIGIBLE

I should also note that my request was changed to cover the period to November 2019.

To clarify, I am requesting access only to checkboxes on 15 pages.

There is no need to engage in a consultation process since I am only requesting the checkboxes with everything else redacted.

The documents as released would literally amount to a few boxes and ticks WITHOUT ANY TEXT.

Here is what a page will look like, for example:

The checkboxes on their own are non-identifying - so no consultation with any third parties is involved and no personal information is involved.

This request is made for documents under the Freedom of Information Act.

The documents I am after are the eligibility and completeness checklists filled out for incubator support initiative 'new and existing incubator' grant applications.

To see what these checklists look like, see the 14th page in this PDF here:

Note, however, that I am only after the first page of the checklists, and only where:
- the relevant grant application was assessed as ineligible; AND
- either the checkbox NEW or the checkbox EXISTING is ticked (checked) on page 1 of the checklist.

Please remove all personal and business information including that of third parties as only the template content of page 1 is required - without the applicants' details. There's no need to reveal the checkboxes either.

Since you've already found the checklists for ineligible applications per LEX 68410, I'm happy to limit the scope of my request to the same checklists (provided they meet the abovestated criteria) so that you don't have to conduct the search again. All that's required is to check page 1 of the checklists and to redact the page if the abovementioned checkboxes are ticked.

To provide these documents, you may simply reply to this email message, as you've done previously.
