109 lilburn street

We're waiting for Nitti to read recent responses and update the status.

Dear Blacktown City Council,

We are planning to build a house in 109, 20 lilburn street, Tallawong (DP1271792). Easement is provided to the neighbourhood lot(ie lot 108) but the same has not been provided to us from lot 110(581 sq meter).
Also for the other similar lots in that area with 10 sq meter width , easement is part of the plan(lot 107, lot 108, lot 116 , lot120, lot 121 and lot 122).

Given our width is 10 sq meter we would require an easement as well to construct a double garage on a zero lot size.

Can you please let you know what would be the next step here?

Hi Nitti,

The Deposited Plan has been registered. Therefore you will need to negotiate with the owners of the lot adjacent to yours (Lot 110) to create an access and maintenance easement that burdens them and benefits you. If they agree to it then then you will have to go through the formal process of registering such easement called an 88K under the Conveyancing Act.

If you your neigbour deos not agree to it then you will not be able to build a zero-lot wall.
