increase in FOI applications received by the AFP over the past several

Thanks for those links Alex. What do you mean, "prevent you being able to apply for IC review"?

I really didn't think it would be that hard to get this document - it seems like a simple request and the file was even listed in the Harradine Report :(

There seems to be something going on with FOI at the AFP at the moment.

Even looking on this website, extensions are requested - it seems - by default.

If they do respond on time, it's right on deadline (for example, your FinFisher FOI request).

It's possible the AFP is under-resourced. The OAIC says in 2012-13, FOI requests increased by 23.4%. They are number 6 across all Departments/agencies for the number of requests.

That said, it may be because they reject so many of the requests. In the same period, the top 20 agencies release in full average was 60% of request. The AFP grant in full only 8.4%. They refuse in full 30%, the top 20 average is 8.7. And for granting in part, the top 20 average is 31.3%. The AFP is way higher at 61.6%.

So you could argue if they spend more time being open and meeting the spirit of the FoI Act, they'd get though the workload quicker.

Continuing on from my previous annotation, s15AC extension is a last ditch effort avoid an IC review by imposing a time period and specific conditions on an agency http://www.austlii.edu.au/au/legis/cth/c...

Presumably if nobody from OAIC has contacted you and there was no extension reference number in the most recent email, the application for an extension has not been received by OAIC, all time limits have expired and you currently have standing for IC review. What would happen if your application for review is received before the application for an extension is left as an exercise for the reader ;)

Extension of time request from the Australian Federal Police

 

On 22 April 2014 the Office of the Australian Information Commissioner
received a request from the Australian Federal Police (AFP) for an
extension of time, to process your freedom of information request.

The AFP has applied for an extension of time under s 15AC of the Freedom
of Information Act 1982 (Cth) because it has been unable to finalise your
request within the initial decision period.

The AFP has advised, in summary, that its reasons for requesting further
time are the large number of documents falling within the scope of your
request; temporary workload/staffing pressures within the AFP FOI team;
and the need for the AFP to consult with the other party to the relevant
MOU. The AFP has been unable to receive a timely responses to its requests
for advice from that other party.

The AFP has requested an extension to 9 June 2014 to finalise this
request. Given the length of the extension requested, before making a
decision we would like to offer you the opportunity to provide comment on
this extension request if you would like to do so.

Please respond to this email by close of business 28 April 2014. If we do
not hear from you by this date, it is likely that we will proceed to make
a decision without your input. When we have finalised this request, you
will be notified and provided with a copy of our decision.

Thanks for the opportunity to provide comment on this extension request.

In the almost four months since I made this request I've found the repeated delays baffling and the communication from the agency confusing. Since I was requesting a file listed in the Harradine Report I thought this would be a simple request that would be promptly fulfilled.

The agency first asked me to consent to a delay because of delays in the "relevant AFP line areas". I agreed to this extension.

Then they delayed it again because they needed to consult with other authorities.

Then after breaching that timeframe they claimed they had a significant increase in the number of FOI requests they had received.

Now they seem to have added two new reasons for delaying my request:

* That they have been unable to get a timely response from the other parties they were consulting with. If this is so, why wasn't it mentioned earlier?
* That there's a large number of documents falling within the scope of my request. This one made me smile because I requested a single item from the Harradine Report. How can there be so many documents? Why is this only mentioned at this very late stage and why only to the OAIC and not me earlier?

Given all of this, it's very hard not to feel like I'm being given the run around. The agency has had more than enough time and should release the document requested.

If an agency fails to meet the processing deadline for an FOI request it is deemed to have refused that request, per s 15AC of the FOI Act.

If this occurs you can lodge an application for review of the deemed refusal decision (via http://www.oaic.gov.au/freedom-of-inform...). If you do so the OAIC would then have jurisdiction to conduct a review in relation to the FOI request, and would be able to assist.

Today I got a call from Ben at the OAIC about my request for Information Commissioner review. He wanted to know if I'd like to withdraw the request since the agency have now made a decision on my request.

I agreed and he sent this follow up email that I've replied to confirming I wish to withdraw the IC review request.
