#2A DoE Reasons for amendments to s 67CC(2)

The request was partially successful.

Dear Department of Education,

This request relates to LEX71589 made to Services Australia. Page and paragraph references in this request are to the decision documents in LEX71589. References to LEX71589 are to the Services Australia FOI request.

I note I have made a similar request to Services Australia. I am happy for the 2 requests to be dealt with jointly, provided all documents within scope of both requests are provided. Or put another way, I don't need to receive the same document via both requests. I trust the 2 departments are able to deconflict in a sensible fashion.

I request:
1. Any emails or written correspondence that are:
a. dated 7 March - 29 November 2022, and
b. related to the amendment to s 67CC(2) (including documents that do not directly mention s 67CC(2) but form part of the considerations that resulted in an amendment to s 67CC(2) being sought), and
c. not already released via LEX71589, and
d. sent or received by an entity acting on behalf of the Department of Education (e.g., employee, contractor, etc.). This includes emails or written correspondence sent directly to or received directly from an external source (e.g., a minister's office).

2. Any documents in the possession of the Department of Education that explain or could be perceived to explain why, from page 2, 'we [the Department of Education?] are looking at amending s 67CC(2)(d)'

3. Any documents in the possession of the Department of Education that confirm who the 'we' is in 2 above

4. Any documents in the possession of the Department of Education, not covered by point 2 above, that provide information as to what caused, prompted, or contributed to, the Department of Education making the 1059 28 July 2022 request for advice (page 2).

5. I am not clear whether the 'comprehensive layperson explanation for internal use only' was later published. Assuming it was not published, or that the internal version is different to the published version, I request the final version of the 'comprehensive layperson explanation for internal use only'.

6. A document setting out, from page 5, any/all 'Minister's Rule changes by 1 July 2023' that are consequent to or otherwise relate to the amendment to s 67CC(2)

7. The names of any CCS claimants, where the Department of Education considered those claimants' claims as part of considering s 67CC(2) amendments (e.g., as an example of why the amendment was needed, or a case study of what the amendment would achieve, or similar). I will grant extensions of time to consult with the relevant third party CCS claimants

8. To the extent not included in point 5 above, a copy of (from page 9) 'the taper graph demonstrating the new CCS rates and a very handy layperson explanation of the amendments in the ED'

9. Documents that set out why the Department of Education thought it mattered to make it so that, from page 15 at [73], 'It would not matter whether or not the child received care for which another individual was receiving CCS.'

10. Documents that set out why, from page 15 at [74], the 'policy intent' needed to be clarified.

11. Documents documents that consider and/or justify, from page 15 at [75], the retrospective application of the amendment.

12. Copies of any emails or written correspondence related to LEX71589 that were sent or received by an SES or equivalent (regardless of which department the SES worked for, and regardless of whether they were in the 'to', 'from, 'cc', or 'bcc' field).

13. Copies of any emails or written correspondence related to LEX71589 that were sent or received by a minister, minister's office, or ministerial staff (regardless of which minister, and regardless of whether they were in the 'to', 'from, 'cc', or 'bcc' field).

14. Correspondence internal to the Department of Education related to LEX71589

15. Correspondence sent to/from the Department of Education/Services Australia and vice versa related to LEX71589

Yours faithfully,

Me

Dear Alison,

Thank you for your letter

Could you please advise how much of the 17.5hrs relates to each of my 15 points?

For example, is it 1.17hrs per point (probably not), or does one point have the majority of the 155 pages, etc?

Yours sincerely,

Education - FOI, Department of Education

Hi Me

Thank you for your email.

The charge is not calculated based on individual parts of your FOI
request. As set out in the charge notice issued to you on 1 May 2023, the
preliminary assessment of the charge payable for the processing of your
request is calculated on the basis of the estimated time spent searching
for and retrieving documents relevant to your request and estimated
decision-making time, which, consistent with the Freedom of Information
(Charges) Regulations 2019 (Charges Regulations), includes the estimated
time spent deciding to grant or refuse a request, including examining
documents, consulting other parties, making deletions, or notifying any
interim or final decision on the request. As noted in the charge notice,
the estimated search and retrieval time is 6 hours, while the estimated
decision-making time is 11.5 hours after the deduction of the first 5
hours of decision-making time in accordance with the Charges Regulations.

The charge is calculated, in part, on the basis of the number of pages
captured by the scope of your request. In your email below, you have
asked, ‘does one point have the majority of the 155 pages?’ I am advised
that the majority of the pages within the scope of your request relate to
part 15 of your request, which is in the following terms:

15. Correspondence sent to/from the Department of Education/Services
Australia and vice versa related to [FOI request to Services Australia
with reference number] LEX71589.

We trust this information is of assistance. If you have any further
questions, please contact [1][email address]. Alternatively, please
refer to the ‘required action’ section of the charge notice for the
options available to you in responding to the charge notice.

Kind regards,

Alison

If I exclude point 15 from the scope, is that sufficient to fall under the charge threshold and/or for DoE to voluntarily waive the charge?

Education - FOI, Department of Education

Hi Me

Thank you for your response.

Under section 8 of the Charges Regulations, the department has the
discretion to impose a processing charge. The charge should reflect an
appropriate contribution towards the time and effort involved in
processing a FOI request, and the costs for processing a FOI request must
be calculated using the hourly rates set out in Schedule 1 of the Charges
Regulations. Accordingly, no ‘charge threshold’ in the manner you describe
exists in relation to FOI processing charges.

As noted in our previous email, the charge is calculated, in part, on the
basis of the number of pages within the scope of your request.
Accordingly, if you were to revise the terms of your request to remove
part 15, the charge would be recalculated and reduced to reflect the fewer
number of pages captured by the scope of your request.

Please let us know if you would like to revise the scope of your request.

Kind regards,

Alison

Dear Alison,

A slightly brutish summary of the below: It will be possible to compel DoE to provide the information with no processing charge. Would DoE like to provide the information for no charge:
- the fast and cheap way, or
- the slow and expensive way?

Fifteen points is not a small FOI request. Nonetheless, I grouped disparate requests into one, because I thought it would be easier and cheaper for the DoE to deal with one request. DoE was not on notice of this consideration, but it was a consideration and it was for DoE's benefit.

At this stage, I am yet to formally apply for no processing charge. If I do so, DoE will incur more cost (time) in considering that application. Further, I think it is quite arguable on relevant grounds that the processing charge should be waived.

If the processing charge is not waived, it is still open to me to amend the scope of my request such that no charge is applicable.

Then, I can make separate FOI requests for whatever it is I have excluded from the scope of this request. DoE will incur more cost in dealing with multiple requests, at least by virtue of multiple letters of acknowledgement and decision etc.

It is true DoE has the power to group similar requests into one; at the same time, I think it is arguable that the 15 points cover distinct issues/documents/purposes, and so DoE will be required to process multiple FOI requests in parallel.

Even if DoE doesn't process the FOI requests in parallel, I can simply wait for the request(s) on foot to be finalised, and then submit another FOI request - that is, FOI requests in series.

The end result is that DoE will expend far more taxpayer dollars by insisting on a processing charge, than DoE will by deciding to waive the processing charge and deal with my request as is.

I am not trying to get in your way. At the same time, if I can avoid a processing charge, then why wouldn't I? It benefits everyone to process my request as is with no processing charge.

Before I respond formally to the processing charge letter, please advise whether DoE intends to continue requiring a processing charge.

Yours sincerely,

Me

Education - FOI, Department of Education

Hi Me

Thank you for your email.

The processing charge has been imposed consistent with the charges regime
provided under the FOI Act and Charges Regulations.

Your options in responding to the charge notice are set out in the
‘required action’ section of the charge notice sent to you on 1 May 2023.
As indicated in the notice, if you would like to seek reduction or
non-imposition of the charge, you should tell us why and give us evidence
to support your reasons.  For example, you may wish to tell us whether
paying the charge would cause you financial hardship and/or whether access
to the documents is in the general public interest or in the interest of a
substantial section of the public.

If you have any further questions, please contact [1][email address].

Kind regards,

Alison

show quoted sections

Dear Alison,

Thank you for your correspondence to date.

I submit any proposed charges are void, and in the alternative, should be waived. Charges cannot be imposed when a decision is out of time. Access to the documents is in the general public interest and the interest of a substantial section of the public.

General public interest
The DoE must take into account the OAIC’s guidelines when making a decision to impose or not impose a charge.

The relevant guideline states that the ‘lowest reasonable cost’ set out in FOI Act s 3(4) is to be interpreted broadly. I covered this point in my email dated 4 May 2023, and I adopt that email as part of these submissions. In summary, it will cost the DoE more to impose a charge than it will cost the DoE to fulfil the request. That, in all the circumstances, it will ultimately be more expensive for the DoE to impose a charge than fulfil the request without a charge, means s 3(4) prohibits the DoE imposing a charge.

DoE should also remember that if their decision to impose a charge is subject to IC review, the presumption is that no charge is to be imposed and DoE will have to prove it is reasonable to impose a charge.

The relevant guideline further state that ‘charges are discretionary and should be justified on a case by case basis’, and ‘the notice to an applicant of a charge fully explains and justifies the charge’. DoE’s letter dated 1 May 2023 gives no such justification. It simply says ‘I [the decision-maker] have decided you are liable to pay a charge.’ Given the 1 May 2023 letter fails to fulfil a mandatory requirement, the decision is infected with jurisdictional error and therefore no decision at all. Consequently, the statutory timeframes for dealing with this FOI request were not ‘paused’, and DoE has exceeded those timeframes. Charges cannot be imposed on an FOI request that is out of time. Further, at this stage the FOI request is, arguably, deemed to be refused. Should the DoE decide to proceed with the request at no charge within 28 days of this letter, I will not use the deemed refusal as a basis to seek review.

The relevant guideline further states ‘a charge must not be used to unnecessarily delay access or to discourage an applicant from exercising the right of access conferred by the FOI Act’. Given that there is no stated justification for the charge, and that Services Australia is processing a near identical FOI request at no charge, and that I know for other reasons that Services Australia disagrees with DoE’s instructions to Services Australia regarding s 67CC(2) such that the documents in question could embarrass DoE, it is reasonable to conclude that a contributing factor for DoE to impose a charge is to make access more difficult. This is a mandatory irrelevant consideration, and its consideration similarly makes the decision to impose a charge void for jurisdictional error and prohibited because a decision on the FOI request itself is consequently out of time.

It is also in the general public interest, as set out in FOI Act s 3(2)(a). The DoE made various decisions about s 67CC(2), potentially contrary to the advice of Services Australia, and while proceedings were on foot. Disclosing the documents is the only way for the public to understand what decision the DoE made and why. Therefore, disclosing the documents is the only way for the public to be able to provide input that could lead to ‘better-informed decision-making’.

It is also in the general public interest, as set out in FOI Act s 3(2)(b). The government’s decisions around s 67CC(2) and childcare subsidies are of particular public interest. They were an issue at the most recent federal election, and election promises were made about them. How the DoE has chosen to understand and action the government’s instructions about these election promises is necessary for the public at large to fully participate in Australia’s representative democracy.

Substantial section of the public
The amendments to s 67CC(2) are directly relevant to a substantial section of the public. A cohort of the public was entitled to more child care subsidy before the amendments than after them. These documents will directly inform that cohort as to what their CCS entitlement was and when.

In particular, despite that cohort being entitled to more CCS before the amendments, neither Services Australia nor DoE has or is undertaking to rectify the underpayment of CCS to that cohort. Disclosure of these documents will assist that cohort to understand why they were underpaid and remain underpaid.

Altogether, the original decision to impose a charge is no decision at all. As a result, the DoE’s decision on the FOI request itself is out of time. Therefore, a charge cannot be imposed. Even if the charge decision is valid and the FOI request is still within time, a charge should not be imposed because it’s in the interest of a substantial section of the public and the public in general to provide access to the documents.

Me

Apologies I should’ve paid more attention to the numbered points

Could I please also exclude points 12, 13, and 14.

That should limit the scope of my request to s 67CC(2) amendments (that is, not including LEX71589).

DoE has successfully undermined the objects of the FOI Act by bureaucratic obtuseness, such that I will pay the charge instead of compelling its non-imposition

I agree to pay the $125. I’ll send the credit card form for the full amount next week. I request DoE commence preparing the documents in the interim. I understand the documents/decision won’t be provided until I’ve paid

Dear Education - FOI,

Thanks. I request to correspond via RTK please.

On payment: thanks for looking into solutions. DoE is making an assumption that’s not my name and signature - I’m not sure DoE is permitted to look behind what I provide. Also, the card name and signature isn’t required for it to work - only number, expiry, and CVV are required.

If it assists, I can call and provide the number. Signatures aren’t required to process credit/debit payments by phone.

In case it’s relevant later, I don’t agree the timeframe is paused. I’ve provided all the necessary paperwork/information; DoE not running the payment is an issue for DoE.

Yours sincerely,

Me

Dear Alison,

My compliments on your decision. It is actually very good. It is apparent you've actually read the OAIC guidelines, turned your mind to the specific circumstances of this application, and otherwise done a great job.

Now just to make all FOI decision-makers clones of you, and the FOI system will function properly!

I am going to submit an internal review, but even so the quality of your decision assists - the internal review will be fairly narrow in scope because you've adequately justified your decision and/or provided enough information that even for documents not released, I have enough idea of what they are to meet my needs

Yours faithfully,
