Department of Industry, Science, Energy & Resources did not have the information requested.

Dear Department of Industry,
I lodged a GIPA request on 27 August 2015.On 7 September I was advised that the information that I applied for is not held by the Department. Subsequent enquiries with the Crown Land Department revealed that following discussions with Manly Council, that Manly Council admitted that they had not lodged the annual returns despite the statutory obligation to do so. They had not been granted any dispensation by the Minister not to lodge these annual reports. The failure to do so was due too a change in the responsible officer in Manly Councilwithout a proper handover and the new responsible officer being unaware of the statutory requirement to lodge these annual returns.
Clearly this is outside of my control. Manly Council undertook to the Department of Crown Lands to lodge the missed annual returns. I am lodging another GIPA request as I was advised to do. I expect that this time around that Manly Council will be forced to comply with the statutory obligations imposed on them as trustee if the returns have not yet been lodged.
