I am writing to request an internal review of National Disability Insurance Agency's handling of my FOI request 'Archive of NDIS webpage 'Frequently asked questions about legislation' (1 May 2025)'.
- I requested a copy of each version of the FAQ webpage that was published between 1 May 2025 and 15 April 2025.
- You've stated that the FAQ webpage only had 2 versions published during that period, the first on 24 April 2025 and the second on 30 April 2025.
- There should be at least 3 versions published during that period.
- I have a screenshot of the "What are flexible and stated supports? (new)" question from the FAQ webpage that displays a different answer than what is shown in the 24 April 2025 version (document 1). I believe the screenshot was made on 28 April 2025 although the change may have occurred prior.
- The 30 April 2025 version (document 2) then shows the question was removed entirely.
Please conduct an internal review of this decision and locate all the versions of the FAQ webpage that were published between the aforementioned dates.

Hi Renee – Thank you. I've been requesting a copy of every version they've published since it was first created but that obviously relies on them not leaving anything out (accidentally or purposefully) which is what went wrong here.

Sure I'll dig em up. P.s. I have MUCH more copies than that, I saved them as pdf files though. I could put them in a folder on my google drive and give you a link or email them to you how ever you'd prefer. I'm not to savvy navigating this website unsure if I can send them on here.

OK so I have 43 copies (pdf) from June 2024 - now...
from both the ndis "improvements" website & the standard ndis website... the legislation frequently asked questions AND the standard frequently asked questions. each time it was updated (I think)

If the 43 includes the two different FAQs and covers May/June which I don't have yet, it might even out to be correct. They’ve given me 29 versions of the "Frequently asked questions about legislation" page, covering from 6 September 2024 to 1 May 2025 (in the 4 requests + 1 internal review).
But I'd definitely still be keen to see yours so I can match them up and find out. The Right to Know website allows me to send you an email via your profile, so I'll do that now. Cheers.

I'm not 100% convinced we have been given all of the requested information but I have no way to prove it (yet).
I made this request because the NDIA updated the FAQ with contradictory information about what is/isn't a stated or flexible support. Without acknowledging their mistake, they have simply pretended it didn't happen and removed the question entirely from their webpage.
It was suggested (in a Linkedin post showing screenshots of the two versions: https://www.linkedin.com/posts/sarah-col...) that the question was first added on 24 April 2025, changed again shortly after to state something different, before the entire webpage was taken down for 24 hours on 29 April 2025, and then put back up on 30 April 2025 with the question removed.
The NDIA have stated here in their internal review decision that only one version of the question was published on the webpage in April (visible publicly from 24 April 2025 until it was removed on 29 April 2025, approx. total 5 days). But that an earlier (different) version was published in March (visible publicly from 24 March 2024 until it was removed on 28 March 2025, approx. total 4 days). These two versions do align with what was shown in the screenshots, although the date and order differs.
Regardless of the exact timing, the fact the NDIA are publishing critical information on how to interpret the NDIS legislation/rules, removing it, publishing a different version, and removing it again, all without any acknowledgement or notification, is EXTREMELY TROUBLING.
Participants rely on the information published by the NDIA to inform them how they are LEGALLY permitted to spend their funding. If the NDIA decide a Participant has misspent their funding (by, for example, using their funding flexibly to purchase a support when the NDIA think it was actually stated funding), then the Participant is stripped of their ability to self-manage their NDIS plan and a DEBT can be raised, forcing them to pay back the funds.
This happens frequently and it destroys lives.
Anyone who has read the FAQ webpage between 24-28 March 2025 or between 24-29 April 2025, and trusted the NDIA's word on how to should interpret the law, is now at increased risk of making a mistake due to the NDIA's actions.
The NDIA haven't clarified which answer (if any) is correct and lawful. And if a Participant is reprimanded, and returns to the FAQ page to look for the advice they were instructed to follow when they used their funds... there is currently NO proof that the advice ever even existed.
The NDIA's deplorable actions should invalidate every misspending claim the agency has raised between 24 March 2025 and whenever they finally get around to clarifying how stated/flexible funding should be interpreted.
Whilst the internal review decision for this request (FOI 24/25-1879) concluded that the original decision was technically correct, their inclusion of the 24 March 2025 webpage does prove that they missed providing this document in my earlier request that was supposed to cover mid February to mid April (FOI 24/25-1758). I'd hope the document's omission was accidental...
I've written a timeline of the FAQ webpage versions relevant to this issue below– including whether or not the stated/flexible supports question was included, and what FOI decision the document can be found in. I have also included the NDIA's two answers to the question "What are flexible and stated supports?":

Flexible support categories:
- Funding for NDIS supports included in the Core support category of the participant’s plan can be used flexibly when they are part of the same fund management type (external).
Stated support categories:
- Stated supports have flexibility within the same support category. For example, Improved Daily Living Skills. You can’t use them flexibly with other types of support categories in your plan.
- Your plan may include information that describes what the support category budget is for. This is to help you understand the purpose and intention of what has been funded in your plan. You still have the flexibility to use your funds for any support as long as its within that same support category.If you’re unsure about your stated supports, ask your my NDIS contact, support coordinator or recovery coach.
