FOI/2013/019

Dear Renai LeMay

Thank you for your email of 30 January 2013, received by the Department of
the Prime Minister and Cabinet (the Department) in which you made a
request under the Freedom of Information Act 1982 in the following terms:

‘…any document put to the Prime Minister or the Department of the Prime
Minister & Cabinet over the preceding calendar year before 24 January 2013
which proposes establishing an Australian Cyber Security Centre’.

Timeframe for receiving your decision

The statutory timeframe for processing a request is 30 days from the date
upon which your application was received by the Department except in
certain circumstances in which case we will notify you of the time
extension.

Removal of officer’s details

It is the Department’s policy to withhold the names and contact details of
junior officers within the Department and other agencies contained within
documents that fall within scope of the request. The names and details of
senior departmental staff would not be withheld unless there were some
reason for that information to be exempt from release. If you require the
names and contact details of junior officers please let us know at
[1][DPMC request email] for the decision-maker to consider; otherwise we will
take it that you agree to that information being excluded from the scope
of your request.

Publication of documents

In accordance with the Government’s pro-disclosure policy agencies are
required to publish information which has been released under FOI on the
agencies’ disclosure logs. If you wish to raise any objections to the
publication of any of the documents which may be released to you please
contact the Department by email at [2][DPMC request email].  Supporting reasons
for any objection would be appreciated.

Charges

Agencies may decide that an applicant is liable to pay a charge in respect
of a request for access to documents. If the Department decides to charge
you in respect of this FOI request, we will send you a preliminary
assessment of the charges as soon as possible.

The Department will write again when we have further information.
Otherwise, further information on FOI processing can be found at the
website of the Office of the Australian Information Commissioner at

Cheers, much appreciated. I acknowledge receipt of this letter. It is my intent to pay 25 percent of the processing charges so that I can receive a decision and a document schedule. This amount should be received by the department in the next few days.

Kind regards,

Renai LeMay

Dear Mr LeMay,

Thank you for your advice of 24 February 2013 regarding payment of a deposit. The Department is yet to receive that payment.

Could you please advise if you have you sent a cheque (or other form of payment) via mail to the Department and, if so, when you sent this?

Dear Mr LeMay,

I am writing to you in relation to your Freedom of Information (FOI) request, of 30 January 2013, which sought access to ‘any document put to the Prime Minister or the Department of the Prime Minister and Cabinet over the preceding calendar year before 24 January 2013 which proposes establishing an Australian Cyber Security Centre.’ As you may be aware, the Department’s decision regarding the documents is due to you today.

Section 15AA of the Freedom of Information Act 1982 (the FOI Act) allows the Department to extend the statutory processing period, by up to 30 days, with the agreement of the applicant. Currently, the Department is not in a position to provide a decision to you by COB today, and so we ask for your agreement to a 14-day extension of time under section 15AA, which will extend the due date of a decision until Friday, 5 April 2013.

If you agree to an extension, please respond to this email, stating your agreement, as the Department will need to notify the Office of the Australian Information Commissioner of the agreement.

In the meantime, we are endeavouring to notify you of a decision on your request as soon as possible.
