I refer to your application dated 15 November 2019, in which you seek
access to documents under the Freedom of Information Act 1982 (the Act) as
follows:

 

“Requesting the documents comprising the briefing pack for Commissioner
Kershaw for senate estimates held on 15 November 2019.”

 

Timeframe

 

Your request was received by this agency on 15 November 2019, and the 30
day statutory period for processing your request commenced from that date.
The due date for your request is 15 December 2019.

 

Information considered irrelevant to the scope of your request

 

The AFP, in its management of FOI requests, excludes the following
information on the basis that is irrelevant to the scope of a request:

 

-              Names of AFP members, other than the Senior Executive.

-              Direct telephone numbers, signatures and mobile telephone
numbers of AFP members.

-              Duplicate documents, including duplicate emails.  The AFP
will only provide emails where they form a final email chain and the
authors/recipients are contained within the final email. 

-              Information that is publicly available, for example,
newspaper articles, online publications including information available on
the AFP Information Publication Scheme and the AFP disclosure log.

 

If you object to the AFP excluding any of the above information, please
advise this office within seven days of receipt of this email.

 

Disclosure of your Identity

 

Should the AFP be required to consult with third parties in accordance
with the sections 26A, 27 and 27A of the Act, please advise us if you have
any objections to those parties knowing your identity for the purposes of
the consultation.  If we do not receive your consent, we will not disclose
your identity to third parties.

 

Information Publication Scheme

I refer to your application dated 18 November 2019 in which you seek access to documents under the Freedom of Information Act 1982 (the Act) concerning the briefing pack for the Commissioner.

Upon consideration of your request, the AFP is of the view that your request will take longer than 30 days to process. The delay is regrettable, however, due to the delay in in receiving your clarification regarding this request, further time will be required by the line area to gather the material. In addition, the FOI team will be required to assess the documents, which I understand is considerable and undertake all necessary clearances. It will therefore not be possible to advise you of a decision by 15 December 2019.

Accordingly, pursuant to section 15AA of the Act, I seek your agreement to extend the period by 30 days to notify you of a decision to 14 January 2020.

I would be grateful if you would advise this office in writing of your agreement to the proposed extension of time.

If you have any queries in relation to this matter, please do not hesitate to contact this office.

Extension of time application by the Australian Federal Police

Dear Mr Smith

I write to advise that on 13 January 2020, the Office of the Australian
Information Commissioner (the OAIC) received an application from the
Australian Federal Police (the AFP) for an extension of time to process
your FOI request of 15 November 2019.

 

The AFP has applied for an extension of time under s 15AB of the Freedom
of Information Act 1982 (Cth) because your request is considered to be
complex.

 

The AFP has advised the OAIC that:

 

o the material was prepared for the purposes of appearing at a Committee
hearing and advice needs to be sought concerning whether the
information is subject to Parliamentary Privilege
o third party consultations will be required as the material contains
third party information
o the material contains information that may be considered deliberative,
and
o the information contained within the documents is sensitive and
further time is required to carefully assess in relation to that
material.

 The AFP has requested an extension for 29 days to 12 February 2020. I
will take any comments you may have to make into account when deciding the
application.

 

Please respond to this email by close of business 20 January 2020. Please
do not hesitate to contact us before this date should you require further
time to provide your response. If I do not hear from you by this date, I
will proceed to make a decision on the basis of the information provided
to me by the AFP.

 

You will be notified of the decision once the matter has been finalised.
