Cohen Holloway Compliance Response Officer

Dear Redland City Council,

Under the Right to Information Act 2009 (Qld), I request access to the following documents relating specifically to Compliance Response Officer Cohen Holloway:

1. All internal communications, emails, file notes, and incident reports authored by or referencing Cohen Holloway concerning dog management actions at 261 Avalon Road, Sheldon QLD 4157, between 10 April 2025 and the present.

2. Any formal complaints, internal reviews, or performance feedback lodged with or about Cohen Holloway in relation to his duties as a Compliance Response Officer between 1 January 2024 and the present.

3. The current Council guidelines, training material, and policies issued to Compliance Officers (including Cohen Holloway) regarding:

Seizure of dogs,

Classification of dog attacks,

Grounds for regulated/dangerous dog declarations,

Use of discretion in conditioning release on property inspections.

This request is made in the public interest to assess whether the officer’s conduct was in accordance with lawful authority and Council policy.

If any documents are exempt, I request the remainder be released under the partial access provisions of the RTI Act.

Dear Council,

I am writing to formally request that Redland City Council provide, without requiring a paid RTI application, all records, evidence, and internal documentation relating to the seizure and ongoing detention of my two dogs, Lexi and Max, associated with CRAM555987 and the alleged incident on 11 April 2025.

This includes, but is not limited to:

Any photos, videos, or witness statements relating to the alleged dog attack;

Officer notes or field reports authored by Compliance Officer Cohen Holloway or other staff;

Internal correspondence, memos, or decisions concerning enforcement and inspection;

Any records Council is relying on to condition the release of my animals on a property inspection.

I believe this material falls within the scope of an administrative release under the Right to Information Act 2009 (Qld), as it:

Directly relates to me and my registered animals;

Is being used by Council to make enforcement decisions that affect my legal rights;

Has not been made available to me despite multiple formal requests.

It is neither transparent nor procedurally fair for Council to rely on undisclosed records to restrict the return of my animals while simultaneously refusing to provide access to those same documents unless I pay a fee.

I respectfully request a written response within 48 hours, confirming whether this material will be released administratively. If not, please provide written justification outlining why this information cannot be disclosed outside of a paid RTI application.

Dear Mr. Scholl,

I write in response to your continued claim that my Right to Information and Administrative Release requests are non-compliant. Despite multiple attempts and communications, I have received no meaningful clarification or support from Council to rectify any alleged issues. Instead, I have now been issued with an infringement notice and a Dangerous Dog Proposal regarding my dog Max, without being provided a single piece of evidence supporting the allegations.

This raises serious concerns about procedural fairness, transparency, and the lawfulness of Council’s actions. I have made several good-faith attempts to access the following:

Complaint details and incident evidence (photos, statements, footage);

Internal assessments or officer notes;

Any justification used in declaring the dog “dangerous” and withholding release;

Evidence relied upon to issue an infringement notice under Section 13.

To date, none of these materials have been disclosed.

I once again request:

1. Immediate clarification on the specific deficiencies in my previous RTI submissions, in writing;

2. Suspension or withdrawal of the Dangerous Dog Proposal and infringement fine until my requests for evidence and procedural justification are satisfied;

3. A clear explanation of how Council can justify escalating enforcement actions without disclosure of the evidence you claim to hold.

Please treat this as a formal complaint and urgent request for internal review. If no reasonable response is received, I will be seeking escalation through the Office of the Information Commissioner and the Queensland Ombudsman.
