Dear Department of Infrastructure and Regional Development FoI Officers,

I am writing to request digital copies (or scans) of all correspondence between Regional Development Australia Whyalla & Eyre Peninsula and the District Council of Franklin Harbor regarding the Lucky Bay harbor expansion project.

I would expect all of the relevant correspondence to have been sent and received between the years 2010 and 2017.

Dear Mr Monceaux,

Thank you for your email. As the Department of Infrastructure & Regional Development has no access to the email systems of Regional Development Australia Whyalla & Eyre Peninsula, or the District Council of Franklin Harbor, then I don't believe we're the best recipient for your FOI request.

I note that Regional Development Australia Whyalla & Eyre Peninsula is not subject to the FOI Act; however, the District Council of Franklin Harbor is subject to the SA FOI Act, so I would suggest that you lodge your request directly with them. Further information is available here:

Section 15 of the FOI Act states that a valid FOI request is required to "provide such information concerning the document as is reasonably necessary to enable a responsible officer of the agency, or the Minister, to identify it", and given that the Department is not best suited to processing your request, I do not currently consider that your request meets this criteria. If you still wish for the Department to process your request, in consideration of the above, then please let me know.
