Dear Office of the Australian Information Commissioner (OAIC),

Under the FOI Act, I seek access to email correspondence between the Information and Privacy Commissioner, Mr Timothy Pilgrim, and the Australian Public Service Commissioner, Mr John Lloyd (in his capacity as Public Service Commissioner or otherwise), between the period of 1 January 2015 to the date of this application.

For the avoidance of any doubt, my request refers to email documents (and any related attachments) sent by Mr Pilgrim to Mr Lloyd, as well as email documents (and any related attachments) sent by Mr Lloyd to Mr Pilgrim (including where Mr Pilgrim has been cc'd).

Documents falling within the scope of my request can be quickly identified and retrieved by searching all items (including archived items) in Mr Pilgrim's email account profile according to persons sent to, and received from.

I am willing to agree to the OAIC redacting, from any relevant document, the personal information of any person mentioned in that document, except where that person was, at the relevant time: i) a public servant; or ii) a member of parliament.

Noting paragraphs 6.153-6.154 of the FOI guidelines, this refinement of my request should negate any need for the OAIC to consult with any third parties under s.27A of the FOI Act.

Information Act 1982 (Cth) (the FOI Act) and received by the Office of the
Australian Information Commissioner (the OAIC) on 24 February 2018.

 

Scope of your request

 

You have sought access to:

 

‘… email correspondence between the Information and Privacy Commissioner,
Mr Timothy Pilgrim, and the Australian Public Service Commissioner, Mr
John Lloyd (in his capacity as Public Service Commissioner or otherwise),
between the period of 1 January 2015 to the date of this application’.

 

You agreed that personal information is irrelevant to the request, except
where that person is a public servant or a member of parliament.

 

Timeframe for dealing with your request

 

Section 15 of the FOI Act requires this office to process your request no
later than 30 days after the day we receive it.

 

We received your request on 24 February 2018 and therefore must process it
by Monday 26 March 2018.

disclosure log unless they contain personal or business information that
it would be unreasonable to publish.

I refer to your request for access to documents, made under the Freedom of
Information Act 1982 (Cth) (the FOI Act) and received by the Office of the
Australian Information Commissioner (the OAIC) on 24 February 2018.

 

Transfer of your Freedom of Information request to the Australian Public
Service Commission

 

I am writing to notify you that the OAIC has transferred your request in
full to the Australian Public Service Commission (the APSC). Under s 16(1)
of the FOI Act, I am able to transfer a request, or part of a request, if
the subject matter of the documents are more closely connected with the
functions of another agency.

 

We received your request on 24 February 2018, and the 30 day statutory
period for processing your request commenced from the day after that date.
The APSC will treat your request as though it received it the same day
that we did. You should therefore expect a decision by 26 March 2018. The
period of 30 days may be extended if consultation with third parties is
needed or for other reasons. They will advise you if this happens.
