Moveable Dwellings, it was revealed that according to council's legal advice there is "no current legal pathway to approve ‘Same Day Granny Flats’ or other similar structures under the Local Government Act 1993." This legal advice was not released, and goes contrary to an overwhelming body of evidence which was presented to council two hours prior in a public forum. We are seeking full disclosure of the legal advice which has been provided to council on the matter of Moveable Dwellings.

I am writing to request an internal review of Bega Valley Shire Council's handling of my FOI request 'Council's legal advice on Moveable Dwellings'.

Better understanding BVSC's legal position on movable dwellings is clearly a matter of public interest. Without better understanding Council's interpretation of Local Government (Manufactured Home Estates, Caravan Parks, Camping Grounds and Moveable Dwellings) Regulation 2021, members of the public are unable to uphold the law as interpreted and enforced by BVSC. I therefore urge BVSC to disclose this ratepayer funded legal advice.
