Hello Karren,

Transcripts of Federal Court proceedings are available for purchase directly from Auscript if you take a look at this website.

Because the documents are available for purchase, the Attorney-General's department probably will reject your request as being invalid. This is because section 12 of the FOI Act says the FOI Act doesn't apply to documents that are available for purchase by the public. Because you can buy them, you can't FOI them.

I refer to your request under the Freedom of Information Act 1982 (FOI Act) for access to documents.

The purpose of this email is to advise you that your request has been transferred to another agency.

Under section 16(1) of the FOI Act, a department can transfer a request if the requested document is not in the possession of the department but is in the possession of another agency or if the subject matter of the document is more closely connected with the functions of another agency.

Accordingly, on 26 November 2018, the department transferred your request to the Federal Court of Australia FOI team.

We received your request on 22 November 2018 and the 30 day statutory period for processing your request commenced from the day after that date. The transfer of your request does not affect the due date for completion of your request. You should therefore expect a decision from the Federal Court of Australia by 24 December 2018. However, the statutory period of 30 days may be extended if the Federal Court of Australia needs to consult third parties or for other reasons. It will cost almost $800 to obtain a copy of one transcript. In Australia we have legislation that protects an individual against discrimination and victimisation. Having recently experienced the legal system which enforces various acts of parliament including various Human Right Acts I have found that it discriminates. Any lawyer will tell you before you proceed the law is not fair. But it should be, otherwise it discriminates.

It goes further then that in that it allows those with deep pockets to victimise for example if I want a transcript of the 4 hours I had to spend listening to a QC Argue with a judge about nothing in order to increase costs (an intimidation strategy) I have to pay $800.

This is a big reason we do not have diversity, our legal system does not encourage it.

If anyone is interested on the factual information let me know and I will provide. I can not provide Privellege information.

We need a Royal Commission into Discrimination, including the behaviours of business and how the law responds to complaints.

I will protest against firstly having to pay $800 to a third party who I suspect makes a profit in order to obtain information which is of interest to the public.

The case involved myself and for that reason I should be provided with a copy of the transcripts free of charge.
