access to the following under the Freedom of Information Act 1982 (FOI

The statutory period for processing your request commences from the day
after Finance received your request.  Your request was received by Finance
on 8 December 2014.  The processing period may be extended if we need to
consult third parties, impose a charge or for other reasons.  We will
advise you if this happens.

 

Liability to pay a charge

You will be notified of any charges in relation to your request as soon as
possible, before we process any requested documents or impose a final
charge.

 

Publication

As required by the FOI Act, any documents provided to you under the FOI
Act will be published on our [1]disclosure log, unless an exemption
applies or the documents are characterised as containing personal
information.  Documents will be published within one working day after
they are released to you.

 

Policy to exclude junior departmental officer contact details

Finance has adopted a policy to generally exclude the names and contact
details of junior staff (non-SES officers) from any documents released
under FOI. Finance’s preference is to reach agreement with FOI applicants
to exclude these details from the scope of the request. Where there is no
objection, the names and contact details of junior officers are redacted
under section 22 of the FOI Act, on the basis that these details are
irrelevant to the request.

Dear FOI Requests,

What an absolute joke! $574 to provide me with three delegation schedules is completely unjustified. Are you seriously suggesting that it will take over 3 hours to retrieve these documents and over 20 hours to determine whether to release them? I find this hard to believe and don't actually find your estimations reasonable. I would like you to consider withdrawing these charges and providing these schedules for no charge. Similar FOI requests I have made to Customs and DVA were responded to well within 30 days and in neither case was a charge applied. I doubt that your delegation instruments are any more difficult to locate and assess than their's.

Dear Department of Finance,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Department of Finance's handling of my FOI request 'Delegation Schedules'.

I have been advised that in order to process my request for three delegation schedules the department deems it appropriate to charge me $574. Apparently this charge does not include 5 hours of free processing time.

I am unconvinced that printing off three schedules and then reviewing them in order to make a decision would even take 5 hours; which supposedly are free. Where does the necessity for paying an additional $574 come into it? You have not actually explained how this figure was arrived at.

The FOI Act was reformed in 2010. These reforms placed new pro-disclosure requirements on agencies and ministers. What a shame that your department is not acting in the spirit of the legislation! Pro-disclosure does not mean pricing FOI requests out off reach of ordinary citizens.

Section 3(4) of the Act states: The Parliament also intends that functions and powers given by this Act are to be performed and exercised, as far as possible, to facilitate and promote public access to information, promptly and at the lowest reasonable cost.

The lowest reasonable cost is FREE.

Please review the decision to impose a disproportionate charge on my request.

In a letter of 23 February 2015, Finance provided you with an internal
review charges decision letter.  The letter indicated that within 30 days
of the date of the letter, you were required to pay the charges or
otherwise contact Finance regarding the processing of your request,
otherwise your request would be deemed withdrawn.

 

As Finance has not received a response from you within the timeframe
indicated, your request is now deemed withdrawn as prescribed by section
29(2) of the FOI Act.
