Dear Special Broadcasting Service Corporation,

I respectfully request the following information under Freedom of Information Act 1982:

1. Documentation in which the reasons for retaining name and email addresses and any other personal information for use of the SBS OnDemand service are justified to SBS management and a copy of that decision.

2. Any documentation in which requests for this personal data collected by SBS are made, whether that request originated from within SBS, or externally.

3. A copy of any relevant policies pertaining to SBS staff who have the ability to access customer data. In particular, I am looking for documentation which assists SBS staff to ensure they are using SBS customer data only for the purpose for which it was collected.

4. A report which describes misconduct of SBS staff generally, including inappropriate access and/or misuse of customer data held by SBS. Please provide the most recent report which covers a one-year period, if one exists.

There is no need to include the Terms & Conditions and Privacy Policy made available through 'http://www.sbs.com.au/ondemand/why-login... as I have already accessed this information.

Extension of time request by Special Broadcasting Service Corporation

I write to you to advise that on 15 December 2016 the Office of the
Australian Information Commissioner (the OAIC) received a request from the
Special Broadcasting Service Corporation (SBS), for an extension of time
under s 15AB of the Freedom of Information Act 1982 (Cth) to process your
freedom of information request.

The SBS has requested an extension to 20 February 2017 because the request
is complex and voluminous and preliminary searches have returned a large
number of records. I am minded to grant the SBS an extension of time but
will take any comments by you into account when deciding the application.

Please respond to this email by close of business 22 December 2016. If I
do not hear from you by this date, I will proceed to make a decision on
the basis of the information provided to me by the SBS.

 

You will be notified of the decision once the matter has been finalised.

Extension of time request under s15AB
On 15 December 2016, the Special Broadcasting Service Corporation (the
SBS) requested further time to make a decision on your FOI request of 12
December 2016.
This request was made on the basis that the processing period is
insufficient to deal adequately with your request because it is voluminous
and complex.
The Information Commissioner has taken your comments into consideration
and decided to grant the SBS an extension of time to process your request
to 20 February 2017. This decision has been made under s15AB of the
Freedom of Information Act 1982 (Cth) (the FOI Act).
By granting further time it is anticipated that the SBS will provide a
well-reasoned and better managed decision.

Special Broadcasting Service (SBS) FoI request 2016/09

I am writing regarding your request for:

"1. Documentation in which the reasons for retaining name and email addresses and any other personal information for use of the SBS OnDemand service are justified to SBS management and a copy of that decision.

2. Any documentation in which requests for this personal data collected by SBS are made, whether that request originated from within SBS, or externally.

3. A copy of any relevant policies pertaining to SBS staff who have the ability to access customer data. In particular, I am looking for documentation which assists SBS staff to ensure they are using SBS customer data only for the purpose for which it was collected.

4. A report which describes misconduct of SBS staff generally, including inappropriate access and/or misuse of customer data held by SBS. Please provide the most recent report which covers a one-year period, if one exists."

SBS has carried out a search for these documents, and has identified over 1000 documents relevant to the request. I am writing to advise that SBS intends to refuse access to documents under s.24 . For the purposes of section 24, s24AA sets out circumstances in which a practical refusal reason exists, which is that in this case, the work involved in processing the documents would substantially and unreasonably divert the resources of SBS from its other operations.

This correspondence begins a formal 14 day consultation process under s.24AB, during which you are invited to:
- Revise the scope of the request; or
- Withdraw the application

As this 14 day period falls within Public Holidays and the SBS shutdown (5 January 2017), the consultation process may be extended to Monday 20 January 2017 (under s24AB(5)).

I would be very happy to assist you in revising the scope of your request. This may include: deletion of duplicate emails; provision of only the final email in a trail, where all previous emails in that trail are set out in the final; or revising the search period. I would also be happy to discuss any specific information that you wish to receive, which may also assist to limit the search. Please do not hesitate to call me to discuss the options further – my contact details are set out below. I am in the office until Friday 23 December, and will be available again when the SBS office re-opens on Monday 9 January.

As you are aware, the Office of the Australian Information Commissioner has granted us an extension for the processing of this FOI request (under s15AB) to close of business 20 February 2017 (ref: RQ16/05433).
