FOI, Department of Home Affairs

UNCLASSIFIED

Dear Mr Green,

Freedom of Information Request - FA 19/03/01223

I refer to your email dated 22 March 2019 in which you requested access to
documents held by Department of Home Affairs under the Freedom of
Information Act 1982 (the FOI Act).

Your FOI request received sought access to:

Documents in relation to the eligibility of persons applying for the
Community Support Program, according to nationality, ethnicity, religion
or place of residence.

Please limit this to briefing papers, reports, guidance notes, policy
documents and advice the senior officials and the Minister.

Please limit this request to only documents since 2013.

On 22 August 2019, the Department notified you of its intention to refuse
your request on the basis that either the work involved in processing your
request in its current form would substantially and unreasonably divert
the resources of Department from its other operations due to its broad
nature, size and complexity, or that the request does not satisfy the
requirement in section 15(2)(b) of the FOI Act, which requires you to
provide such information concerning the document you are seeking access
to, to enable the Department to be able to identify it.

In particular, the Department notified you that, within 14 days of receipt
of that letter, you must advise Department that:

·         you wish to make a revised request; or

·         indicate that you do not wish to revise your request; or

·         withdraw your request.

The 14 day period has now expired.  As such, in accordance with section
24AB(7) of the FOI Act, Department considers that your request has been
withdrawn.

If you have any enquiries concerning this matter, please do not hesitate
to contact an FOI officer at [1][DIBP request email]

Dear FOI,

Thank you for your correspondence dated 22 August 2019 in relation to FOI request FA 19/03/01223. I note some confusion because subsequently, on 23 August, a response to a different FOI request (FA19/03/01219) was assigned to this request on the "Right to Know" platform.

I see you have provided a link to a document released under a previous FOI request, FA 18/08/00011. I am happy to limit the scope of my request to the document released under that request, however, I disagree with the decision to redact that document. In particular, I seek the information redacted, under the heading, "Priority caseloads for the offshore Humanitarian Program in 2017-2018" on page 9 and under "Applications that should not be proposed" on page 10.

Yours sincerely,

Michael Green

Dear Mr Green,

Your change to the scope of application number FA 19/03/01223 is noted. The Department had issued you with a deemed-withdrawl of the application at 4.03pm though your change to scope was received at 4.05pm. Owing to the confusions with email address, we will re-open this case and continue with assessment, taking into account your changes to scope.

For clarity, we will work to your revised scope on this case as follows:

"Full, un-redacted access to the Community Support Program's specific Guidelines prepared for Approved Proposing Organisations (APO’s)"

FOI Reviews mailbox, Department of Home Affairs

UNCLASSIFIED

Dear Mr Green,

I am writing in reference to your two Freedom of Information (FOI)
Internal Review requests (Ref FA19/03/01208-R1 and FA19/03/01215-R1) which
I am currently assessing.

You requested that the Department review the deletion of information
irrelevant to your requests under section 22(1)(a)(ii) of the FOI Act .

Section 22(1)(a)(ii) of the Freedom of Information Act (FOI Act) permits
an agency to prepare an edited copy of a document, deleting information
that would reasonably be regarded as irrelevant to the request.

The scope of the above FOI requests was as follows:

+------------------------------------------------------------------------+
|FA 19/03/01208|Documents relating to Australia’s priorities in relation |
| |to the nationality, ethnicity or religion of persons |
| |resettled under Australia’s offshore humanitarian |
| |program. Please limit this to briefing papers, reports, |
| |guidance notes, policy documents and advice the senior |
| |officials and the Minister. Please limit this request to |
| |only documents since 2013. |
|--------------+---------------------------------------------------------|
|FA 19/03/01215|Documents relating to the Commonwealth's regional and |
| |global priorities in the Global Special Humanitarian |
| |program. Please limit this to briefing papers, reports, |
| |guidance notes, policy documents and advice the senior |
| |officials and the Minister. Please limit this request to |
| |only documents since 2013. |
+------------------------------------------------------------------------+

The scope of these two requests was quite specific, which resulted in some
text being deleted under section 22(1)(a)(ii) as irrelevant to the topic
of your request.

I note that on 11 December 2019, you lodged a new FOI request (Reference
19/12/00646) which seeks access to the documents considered in
FA19/03/01208-R1 and FA19/03/01215-R1 specifically by name.

As you have not confined your request to a specific topic in
FA19/12/00646, the whole document, rather than the topical content, falls
within scope of your new request. As such, it is likely that significantly
less information will be assessed and deleted as being irrelevant to your
request.

Accordingly, I am writing to ask if you wish to withdraw internal reviews
FA19/03/01208-R1 and FA19/03/01215-R1, which are confined to the topical
content of your request, pending the outcome of FA19/12/00646.

I note that three documents which were captured by FA19/03/01208-R1 and
FA19/03/01215-R1 are not included in FA19/12/00646. These documents are:

+------------------------------------------------------------------------+
|Document Number|Description |
|---------------+--------------------------------------------------------|
|Document 3 |A letter to then Minister Bishop from then Minister |
| |Morrison dated 4/1/2013. Section 22(1)(a)(ii) was |
| |applied to an internal phone number on page 4. |
|---------------+--------------------------------------------------------|
|Document 17 |Minutes of a Teleconference with the UNHCR. Section |
| |22(1)(a)(ii) was applied to the names of participating |
| |UNHCR staff on page 1. |
|---------------+--------------------------------------------------------|
|Document 19 |Proposed 2018-19 Humanitarian Program Composition. |
| |Section 22(1)(a)(ii) was applied to a footnote on page |
| |1. |
+------------------------------------------------------------------------+

I would be happy to continue with my assessment of these documents, should
you wish.

If you could please consider the above and respond by return email, I
would be most appreciative.

Kind regards,

FOI Officer

Dear FOI reviews officer,

re. Ref FA19/03/01208-R1 and FA19/03/01215-R1

Thanks for your update. As you note, I am awaiting the outcome of my newer FOI request, FA19/12/00646, covering the documents I had earlier received in substantially redacted form.

However, I disagree that my earlier requests were quite specific. From the context of the documents I received, it appears to me that much of the content redacted was relevant to those requests.

Therefore, before I consider withdrawing the internal reviews, I wish to await the outcome of FA19/12/00646, as I do not yet know how much of the same content will be redacted. If I receive the documents with that content un-redacted, then I will certainly withdraw the internal reviews.

In relation to the three documents you identified that I did not include in my subsequent request, it appears likely that the content redacted relates to personal information of staff. I am not seeking that information from those documents.

Yours sincerely,

Michael Green

Dear Mr Green,

I am writing in reference to your two Freedom of Information (FOI)
Internal Review requests (Ref FA19/03/01208-R1 and FA19/03/01215-R1).

On 5 February 2020, I wrote to you asking if you wanted to withdraw these
internal review requests as you had lodged a third access request
(FA19/12/00646) seeking access to the same information.

On 6 February 2020, you advised that you wished to suspend your internal
review until such time as FA19/12/006646 was determined.

I note that FA19/12/006646 was finalised on 4 June 2020, granting you
greater release.

I am therefore writing to you to ask if you wish to withdraw internal
review cases FA19/03/01208-R1 and FA19/03/01215-R1, which have effectively
been superseded by the decision on FA19/12/006646.

Please note that if you withdraw internal review cases FA19/03/01208-R1
and FA19/03/01215-R1, you are still open to request an internal review of
FA19/12/006646 within 30 days of the decision date.

If you could please advise your decision by return email, I would be most
appreciative.

Kind regards

Dear FOI Reviews mailbox,

Thank you for your message and for prompting me about this. Yes, I agree to withdraw my two internal review requests (Ref FA19/03/01208-R1 and FA19/03/01215-R1), now that I have received the documents a little less redacted through the subsequent FOI request.

Yours sincerely,

Michael Green
