On 1 April 2023, you requested access to documents held by the Department of Infrastructure, Transport, Regional Development, Communications and the Arts (the Department) under the Freedom of Information Act 1982 (the FOI Act).

We note that the records relating to your request date back to the 1980's and involve the retrieval of hard copy legacy files and the search and retrieval process has been complex as a result of that. In addition, the Department is currently processing a larger than usual number of FOI requests.

In the circumstances, we will require additional time in order to finalise a decision on access to the documents relevant to your request to ensure that it is as fulfilled and well informed as possible.

Section 15AA of the FOI Act enables the Department to seek your agreement to an extension of up to 30 days. At this point, we are requesting a 14-day extension.

If you agree to this extension, the due date for a decision to be provided to you will become 15 May 2023.

If you do not agree, we will need to consider seeking an extension from the Office of the Australian Information Commissioner.

Good morning

I refer to your request for access to documents held by the Classification
Board (the Board) under the Freedom of Information Act 1982 (FOI Act).

Notification of Third-Party Consultation and Extension of Time

Your request captures documents which contain information concerning the
business, commercial or financial affairs or an organisation, or a
person’s business or profession affairs. Under section 27 of the FOI Act,
the Department is required to consult with the affected person or
organisation before making a decision on access to those documents.

For this reason, the period for processing your request has been extended
by 30 days under section 15(6) of the FOI Act in order to allow the Board
time to consult with the relevant person or organisation. As such, the
statutory due date for your request is now 14 June 2023.   I do note that
you have previously agreed to a 14-day extension of time. As such, the
Board will continue to process your request as quickly as possible and
will endeavour to finalise it before 31 May 2023 to reflect the extension
already agreed by you.

The consultation mechanism under section 27 applies when we believe the
person or organisation concerned may wish to contend that the requested
documents are exempt because their release would disclose trade secrets or
commercially valuable information or may adversely affect their business
or financial affairs.
