Thank you for your email. Under the NSW Food Regulation Partnership
between Council and the NSW Food Authority, Council is required to report
on a number of issues similar to your request. In the first instance I
would refer you to the NSW Food Authority website
[1]www.foodauthority.nsw.gov.au where the activity reports are publicly
available. I also refer you to the NSW Food Authority’s Name and Shame
register where food businesses that are issued with a Penalty Infringement
Notice are publicly available.

 

Should you then require further detailed information, it will be necessary
for you to lodge a 'formal' Government Information (Public Access) Act
application in respect of the requested documentation.

 

I have attached an application form for your convenience. The completed
application should be lodged with Council together with the relevant
application fee of $30.00. Once received, the application will be dealt
with in accordance with the relevant legislative requirements.

 

You should note that time-based processing charges apply to determining
such an application ($30 per hour).

 

I note you have also sent this request to Greater Taree Council and
Gloucester Shire Council. On 12 May 2016, our three Councils were merged
into one, Mid-Coast Council. This email acts as a response to the three
requests you have made.

As the information requested will require significant use of Council resources to search and collate the information requested, our standard practice is to treat this as a Formal request and as such fees apply to allow for the recovery of some of the costs. Using a Formal Application also gives you a certainty around the timing of receiving the information.

I have been informed by other councils this information is available here http://www.foodauthority.nsw.gov.au/rp/f... and I have requested it broken down by council area directly from the NSW Food authority. As I understand it under the Food Regulation Partnership all councils are required to annually report on their food regulatory activities.

So, hopefully, I will not need to request any further information from your council as the authority will release it for you.
