Transfer of freedom of information request to another agency

I refer to your request received by the Department of Health (the
department) for access to documents under the Freedom of Information Act
1982 (FOI Act). You have requested access to:

 

(a) All documents held by the Department relating to the formation of the
"Premier Golf League" Since 1 January 2019 

(b) All Documents held by the Department relating to the formation of "LIV
Golf", the entity launched with Greg Norman as CEO, since 1 July 2021

(c) All documents held by the Department that contain the phrase "Public
Investment Fund", with reference to the sovereign wealth fund of Saudi
Arabia

I am writing to tell you that the department has transferred your request
to the Australian Sports Commission.

Under section 16(1) of the FOI Act, the department is able to transfer a
request if the subject matter of the document is more closely connected
with the functions of another agency.

On 17 June 2022 the department transferred your request to the Australian
Sports Commission whose functions are more closely connected to the
subject matter of your request.

We received your request on 10 June 2020 and the 30-day statutory period
for processing your request commenced from the day after that date.
Australian Sports Commission will treat your request as though it received
it the same day that this department did. You should expect a decision
from the Australian Sports Commission by 10 July 2022. The period of 30
days may be extended if Australian Sports Commission needs to consult
third parties or for other reasons. They will advise you if this happens.

An FOI officer at Australian Sports Commission will be in contact with you
shortly.

Dear Alex, 

I refer to your request received by the Australian Sports Commission (ASC)
for access to documents under the Freedom of Information Act 1982 (FOI
Act). You have requested access to:

We received your request on 17 June 2022. However, your request was
originally received by the transferring agency (Department of Health) on
10 June 2022 and therefore the 30-day statutory period for processing your
request commenced from that date. You should expect a decision from the
ASC by 10 July 2022. The period of 30 days may be extended if we need to
consult third parties or for other reasons. We will advise you if this
happens.

Charges

I have determined that there may be a liability to pay a charge in respect
to this request. Once I have determined the extent of documents required
to fulfil this request I may send you a notice outlining the estimated

Disclosure of public servant's names 

Section 22 of the FOI Act provides that information that would reasonably

Please find below my formal decision in relation to your
recent FOI request. 

  

NOTICE OF DECISION 

I refer to your request to the Australian Sports Commission (ASC)
originally made to the Department of Health on 10 June 2022 seeking access
under the Freedom of Information Act 1982 (FOI Act) to: 

  

(a) All documents held by the Department relating to the formation of the
"Premier Golf League" Since 1 January 2019 

(b) All Documents held by the Department relating to the formation of "LIV
Golf", the entity launched with Greg Norman as CEO, since 1 July 2021 

(c) All documents held by the Department that contain the phrase "Public
Investment Fund", with reference to the sovereign wealth fund of Saudi
Arabia 

  

As the request was transferred to the ASC, I have taken the wording
'Department' to refer in this instance to the ASC.

I am an officer authorised under section 23 of the Act to make decisions
in relation to requests for access to documents.  This letter sets out my
decision in relation to your request being dealt with by ASC and the
reasons for that decision. 

 

Advice 

I have searched the ASC's information and records holding system (Office
365 platform searched through the Security and Compliance console) but
have been unable to find any documents relating to your request. 

I confirm that I used the search terms and date ranges as described in
your request. 

I confirm that all reasonable steps have been taken to find
the documents supplied in your request.  

I am satisfied that the documents referred to in your request do not
exist. 

  

Decision 

My decision is to refuse access under section 24A(1) of the FOI Act, on
the grounds that all reasonable steps have been taken to find
the documents and I am satisfied that the documents do not exist. 

As the documents do not exist, I am refusing your request for access.  

 

Review rights 

If you are dissatisfied with my decision, you may apply for an internal
review or Australian Information Commissioner (Information Commissioner)
review of the decision. 

 

Internal review 

Under section 54 of the FOI Act, you may apply in writing to the ASC for
an internal review of my decision.  The internal review application must
be made within 30 days of the date of this notice (or such further period
as ASC allows).  Where possible please provide reasons why you consider
review of the decision is necessary.  The internal review will be carried
out by another officer of this agency within 30 days.  An application for
