Sent 4 days ago: Hi thanks for getting back to me I'm requesting an internal review of the decision sent on 13 November 2025 for FOI 166.
My original request was submitted on 13 October, so the statutory 30 day timeframe ended on 12 November. As the decision arrived after the deadline, a deemed refusal occurred under s 15AC of the FOI Act. On that basis, Iâm seeking an internal review.
Iâm also asking for review because the search for documents doesnât appear to have been adequate. My request specifically sought the justification and approval for using a Limited Tender under CPR 10.3(e) for CN4172033, along with the document(s) recording the decision to select G3 Advisory. None of the documents provided cover this. Thereâs no CPR 10.3(e) justification, no procurement plan, no value-for-money assessment, and no approval for using the exemption.
AusTender confirms that CN4172033 was awarded under a Limited Tender with CPR 10.3(e) and only one supplier invited, which means those records must exist. Since they werenât identified or released, I believe the initial search was incomplete.
The previous supplier for the an ICT Contract & Finance Management role was Oakwood Business Services (Contract P000129). The current supplier is G3 Advisory. Public records show both entities are owned or controlled by the same person, but theyâre separate legal entities with different ABNs. CPR 10.3(e) can only be used when extending the same supplier, so its application here doesnât appear consistent. This makes the missing procurement documents, especially the transition decision from Oakwood to G3 and the justification for applying CPR 10.3(e), important to the scope of my FOI.
Can the internal reviewer please conduct a fresh search for:
1. The CPR 10.3(e) justification and approval for CN4172033.
2. The document(s) recording the decision to select G3 Advisory.
3. Any documents relating to the transition from Oakwood Business Services to G3 Advisory, including approvals, continuity rationale, or procurement analysis.
Just a heads up I've included department of finance in this conversation just to ensure everything goes smoothly and keep them updated on this matter
Please identify which public servant was responsible for conducting and resolving the foi request. Also please advise me of the person conducting the review and ensure they have not been involved in the decision making.

We acknowledge our honest mistake of missing the 30 day statutory deadline for your Freedom of Information (FOI) request.
We have spoken to the Office of the Australian Information Commissioner (OAIC) about your matter. The advice we have received is that because we have missed the deadline, the decision is a 'deemed' decision under 15AC of the Freedom of Information Act 1982 (the FOI Act). Therefore, Internal Review is not available to you (see section 54E(b) of the FOI Act). You are still able to approach the Information Commissioner for a review.
