Firstly, thank you for your patience in waiting to receive a response to this request.

I forwarded your enquiry to several business units and the City's Greening and Leisure Team was able to advise the following:

Under the Biodiversity Conservation Act 2016 (BC 2016), a landholder (be it private or government) must seek a licence to harm from the NSW Department of Planning, Industry and Environment (DPIE) for any action that may harm (which includes trap and euthanase, catch and release, nest removal or kill) a protected species (as listed in Schedule 5 of the act). The DPIE holds a public register of all licences to harm that have been granted since 2017 (since the act commenced). The register can be found at :

Accordingly, there has been 35 licences issued that are relevant to the City of Sydney LGA since 2017, which includes:
1 x harm to kangaroo
25 x other animals
4 x general site specific
5 x general non-site specific

Further, the City's Urban Ecology Coordinator advised that they are currently awaiting a response from the DPIE to further clarify conditions around licence reporting in the LGA.

Once this clarifications has been received I shall advise you further.

Dear Dave,

The City's Urban Ecology Coordinator has just received clarification from the Department of Planning Industry and Environment. They clarified that:

1. National Parks and Wildlife Service, who review and issue the Landholder's Licence to harm protected native animals are not in the standard practice of informing council when a Licence to harm has been issued. This would explain the lack of information related to these licences in the City’s records.

2. Condition 12 of the non-site specific licence, is an older historical clause that neither the licence holder or council really used. As of last year it has been removed from the non-site specific licence conditions, and the DPIE was not aware the condition was still present on their website. The DPIE are now aware, and are in the process of updating their licence on their website.
