Hobart RWY 30 RNP-AR - Complaint listings

Response to this request is long overdue. By law, under all circumstances, Airservices Australia should have responded by now (details). You can complain by requesting an internal review.

Dear Airservices Australia,

Could I also obtain a copy of Airservices Australia's complaint documents and listings recently provided by ASA to a Hobart journalist.

Yours faithfully,

Cathy Minnucci

Hi Cathy

My name is Saira and I'm the new FOI Officer with Airservices.

I refer to your email sent on 7 August where you've requested access to the following documents:

Could I also obtain a copy of Airservices Australia's complaint documents and listings recently provided by ASA to a Hobart journalist.

To assist me to be able to identify the documents you are seeking access to, could you please provide me with some more context? Answering some of the following questions would be helpful to me:

- Could you provide a copy of the article you're referring to?
- Which news publication and/or journalist?
- What was the complaint/listings about?
- What time period was involved?

Thanks for your assistance
Saira.

It seems strange that the website has nine complainants from Primrose Sands addressing five issues. Primrose Sands is not a vast suburb, yet Airservices Australia feels it is okay to tell a journalist one resident made 1475 complaints. The lack of ethics is beyond belief. What was Airservices Australia hoping to achieve by releasing such information?

Dear MBX FOI,
Thank you Kathryn,

Thank you for this information.
I am assuming all NCIS contacts are included in this information?

I would also like to respectfully note the following......
The information provided to the Hobart journalist and the perceived public profiling of a resident in a rural community raises serious ethical and privacy issues.
This level of information is not available on your public site.
I would have to question why Airservices Australia would knowingly release such information given the known ongoing community stress and health impacts, from this low, noisy polluting flight path.

Yours sincerely,

Cathy Minnucci

Dear MBX FOI,

With due respect...could I please obtain an answer to my previous question...

I am assuming all NCIS contacts are included in this information?

Is this assumption correct or not??

Yours sincerely,

Cathy Minnucci

The response and question/s above do not provide grounds for internal
review under the FOI Act which is why they have not been registered or
addressed by Airservices FOI under the FOI framework. The website you use
also appears to generates an auto email titles of ‘internal review’ when
responding to a decision email. For context, the FOI Guidelines provide at
9.1 :

Availability and purpose of internal review

Part VI of the FOI Act provides for internal review of agency decisions in
2 circumstances:

o an FOI applicant whose FOI request is refused may apply to the agency
for review of its original decision. The internal review can extend to
a decision to refuse access either in full or in part, to defer access
to a document, to a decision about FOI charges, to give access to a
document to a qualified person, or to a refusal to amend or annotate a
personal record. [note: redactions were made under 47F in your
decision and deletions under s22]
o a third party who is affected by a decision to grant access to a
document in accordance with an FOI request may apply to the agency for
internal review of its decision to grant access [note: not applicable]

Internal review does not relate to the ‘handling’ of an FOI request;
however, you may make a complaint to the Information Commissioner as
stated in your decision letter:

Complaints to the Information Commissioner
You may also complain to
the Information Commissioner concerning action taken by an agency in
the exercise
of powers or the performance of functions under the FOI Act. There is no fee for
making a complaint. A complaint to the Information Commissioner must be
made in writing. Further
details on this process can be found on their website
at[1] https://www.oaic.gov.au/.

Other options to address your concerns outside the FOI framework include
reaching out to Airservices Community Engagement who can assist with
general enquiries or NCIS in relation to noise complaints.

Please let us know if you have any further questions otherwise as noted
above, we confirm your response/questions are not being addressed by FOI
or reviewed as an internal review under the FOI Act.

Kind regards

Dear MBX FOI,

Thank you Kathryn,

Based on the information provided...... I am assuming all NCIS contacts are included in this information data?

I am still waiting on clarification to above question.
Do NCIS include ALL contacts in their data listings as COMPLAINTS by complainants?
(ie any contact by phone, emails, questions, clarifications, follow up ??).

Yours sincerely,

Cathy Minnucci
