I would like copies of submission to Council for ownership of Moores Lane

Dear Singleton Council,

I hereby request that you provide me with copies of all documentation submitted by Mr. Neville Whiting that were tabled at Councils meeting on 08/08/2016 regarding the ownership of Moores Lane Elderslie. This was recommendation DCS62/16 item g from the Roads Advisory Committee to that Council meeting.

I can see no reason why this cannot be provided as I am a resident of Moores Lane and have been for approximately 20 years and was the only property that was left out of this "ownership" of the lane that Council approved on the date mentioned.

So again please supply me with copies of ALL documents submitted by Mr. Whiting to Council.

Good Morning,

Any request for information that is not already released publically by council is required to be applied for with a formal GIPA. There is a $30 fee associated with this to be paid at the time of request.

Council has a responsibility to decide an access application and give notice with the decision within 20 working days after Council receives the application. This may be extended a further 15 days if special circumstances apply, such as the need to consult with a third party or when records need to be retrieved from archives.

If your application concerns the personal or business affairs of a third party, Council is required to take reasonable steps to consult with the third party to obtain their views. Council must take into account any views offered by a third party when making its decision.

If the information requested breaches the privacy act, it will not be released and the $30 fee is non-refundable.

Dear recordsmbx,

I have already approached council under the GIPA system to obtain a copy of the documents I have requested only to be told that they cannot be released without the prior consent of Mr. Neville Whiting which I cannot understand as this does not relate to his personal business affairs (it relates to a lane that I am a landowner in) and as this was an OPEN Council meeting I understand that under this States laws I am quite entitled to obtain a copy of all documents submitted to a Council meeting without having to pay any fees other than normal photocopy fees nor is it necessary to obtain approval from the person who submitted these documents.

So please now provide me with the copies I have requested. I am quite happy to pay for any photocopy fees.

As previously stated if you wish to obtain documents that another person has submitted you will have to apply for a formal GIPA at a cost of $30.00. Legally Mr. Neville Whiting is the owner of all documents he submits and Council are required by law to obtain permission from him (a third party) when making its decision to release information.

Dear Singleton Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Singleton Council's handling of my FOI request 'I would like copies of submission to Council for ownership of Moores Lane'.

From the link below you will see that we have been unable to obtain copies of the submission documents provided by Neville Whiting to the council meeting on 08/08/2016 relating to council taking ownership of the lane we live in.

We cannot understand why we cannot obtain copies without Neville giving his permission as we own the last residence in the lane in question and are in fact the only property that wasn't included in his submission. Plus the fact that his property had nothing to do with the subdivision of lot 12 Moores lane back in 1990 which we believe he has used as part of his request for council to take ownership. It was our property that was subdivided off creating lots 121 & 122. Our property being lot 122. We also know that a copy of these documents was provided to at least one other resident in the lane by Neville and we cannot understand why he is reluctant to allow us to have a copy under the GIPA system. We can only assume that he is hiding something from us?

We also believe, as previously stated, that the State law allows us to obtain a free copy of any documents that were a part of an OPEN council meeting which the August 2016 meeting was. We already have copies of the minutes and Agenda so please do not suggest we get copies of these, they tell us nothing other than the decision that was made.
