Internal Review Access and Revocation Practice Guide and Standard Operating Procedure, and "Key Indicators"

I am requesting access under the Freedom of Information Act 1982 (FOI Act), to the following documents listed in your disclosure log:

– 22/23-1667 Internal Review Access and Revocation Practice Guide
– 22/23-1539 Fact Sheet - Free Text ‘reason for our decision’ providing guidance on writing style for reasons for decision.

I am also requesting the document which is referred to in the Internal Review Access and Revocation Practice Guide as "Complete an Access or Revocation Internal Review Decision Standard Operating Procedure".

Additionally, the Internal Review Access and Revocation Practice Guide mentions “Key Indicators”. I am also requesting access to any other documents (currently in use) which define the phrase, provide examples of, or discuss “key indicators” that are used as “evidence” in determining participant eligibility.

Hi RC! I haven’t done either yet, but I may. I’ve seen some other requests with the agency take up to 8 months on here, so I haven’t lost hope yet haha. Hoping that if I keep bothering them regularly they will give in.

I’m concerned that if I request an internal review that they will just close the request, because technically at this point it’s considered a “deemed refusal” and the FOI Act doesn’t allow for internal reviews of a deemed refusals because there is no “decision” to review.

I’m using a pseudonym on here so a review with the QAIC is a bit tricky, and not my first choice. I also already have a review with them for something else and it’s pretty slow moving, so I’m not sure it will get me there any faster than just persisting here for a while longer.

So my plan for now is to just continue to be a pest and I’m doing the same with my other requests which are also overdue… Taking the Shawshank Redemption approach haha

Hi Emily,

I do not believe using a pseudonym will interfere with your ability to liaison with the OAIC. I have seen completed IC Review's on AustLII with applicants who use pseudonyms. If you do not wish to use the OAIC's website you can use the RTK website to request an IC review with the OAIC.

A more recent version (V11.0) of the "Internal Review Access and Revocation Practice Guide" was released as a part of FOI 23/24-0370, and that gives some further "key indicators". You can download it here: https://drive.google.com/file/d/1soXTxqg...
