Legal services expenditures and conflict of interest

Dear Office of the Australian Information Commissioner,

A recent foi released documents referring to numerous seconded external law firm employees working embedded in the OAIC. These are law firms also working as representatives for agencies and organisations that are respondents in matters before the OAIC.

I request copy of any document that refers to how such conflicts of interest are managed.

I also request copy of a document listing cost of expenditure of external legal services (including the cost of seconding of external lawyers) for the financial years 2012-2022, by financial year.

I also request a list of external legal firms who have had seconded their employees to the OAIC, by number of employees seconded, in FY2021-2022 and FY2020-2021.

Freedom of Information request

 

I refer to your request for access to documents made under the Freedom of
Information Act 1982 (Cth) (FOI Act).

Your FOI request was received by the Office of the Australian Information
Commissioner (OAIC) on 5 November 2022. This means that a decision on your
FOI request is currently due on 5 December 2022.

Scope of your request

Your FOI request was made in the following terms:

“A recent foi released documents referring to numerous seconded external

I request copy of any document that refers to how such conflicts of
interest are managed.

the financial years 2012-2022, by financial year.

 

I also request a list of external legal firms who have had seconded their
employees to the OAIC, by number of employees seconded, in FY2021-2022 and
FY2020-2021.”

 

In order to process your request as efficiently as possible, I will
exclude duplicates and early parts of email streams that are captured in
later email streams from the scope of this request, unless you advise me
otherwise.

We will not identify you as the FOI applicant during any consultation
process, unless we seek your permission. However, documents that are
within the scope of your request that we may need to consult third parties
about may contain your personal information.

Timeframes for dealing with your request

Section 15 of the FOI Act requires the OAIC to process your request no
later than 30 days after the day we receive it. However, section 15(6) of
the FOI Act allows us a further 30 days in situations where we need to
consult with third parties about certain information, such as business
documents or documents affecting their personal privacy.

The current decision due date for your request is 5 December 2022.  We
will advise you if this timeframe is otherwise extended.

Disclosure Log

Documents released under the FOI Act may be published online on our
disclosure log, unless they contain personal or business information that
would be unreasonable to publish.

‘FY2021-2022 and FY2020-2021’ could you please kindly confirm whether in
the first paragraph extracted above you intended to refer to ‘2012-2022’
or if this is intended to read ‘2021-2022.’

It would be much appreciated if you could please confirm this by 12 pm on
Tuesday 15 November 2022. If we do not receive a response by this time we
will proceed with processing your request on the basis that you have
intended to request the cost of expenditure of external legal services for
the financial years 2012-2022 as written in your request.

Commissioner (OAIC) on 5 November 2022.

organisation’s business or professional affairs and third-party personal

individuals and organisations under s 27 and/or s 27A of the FOI Act
before making a decision on the release of those document(s).
