Your Freedom of Information request
I refer to your letter received on 15 February 2016.  We have treated this
letter as a request for access to documents under s 15 of the Freedom of
Information Act 1982 (Cth) (the FOI Act).
Scope of your request
You are seeking access to:
…a copy of documents submitted by the Privacy Commissioner under Privacy
Commissioner v Telstra Corporation Limited (VID38/2016) and
any documents received by Telstra under same.
I have interpreted the first part of your request to mean documents
submitted by the Privacy Commissioner to the Federal Court in relation to
Privacy Commissioner v Telstra Corporation Limited (VID38/2016). I would
be grateful if you could clarify what you refer to as ‘any documents
received by Telstra under same’.
To assist in processing your request within the relevant timeframes, I
would appreciate if you could clarify the scope of your request by 25
February 2016.
Timeframes for dealing with your request
Section 15 of the FOI Act requires that we process your request no later
than 30 days after the day on which we received your request. However,
section 15(6) of the FOI Act allows us a further 30 days in situations
where we need to consult with third parties about certain information,
such as business documents or documents affecting their personal privacy.
As we received your request on 15 February 2016, we must process your
request by 16 March 2016. However, if we are required to consult with
third parties, we must finalise your request by 15 April 2016. Of course,
we will endeavour to provide you with our decision as soon as practicable.
