Dear Victorian Department of Justice & Regulation,

Under Freedom of Information Act (FOIA), i would like to request information pertaining to the Owners Corporation Act 2006 - Part 9 -Owners Corporation Register.

I require a list of all current owners corporation plans within post code 3004, with the associated owners corporation register details (Sect 148):

1) the owners corporation plan number and physical address;
2) the name of the manager, registration number of the manager and contact details of the manager (if any);
3) The number of lots in the building

If you need any clarification of this request of if it is too broad in any way please feel free to email me.

If this information is held by an outside contractor then it is your responsibility under the FOIA to obtain that information.

Due to financial hardship, i cannot make payment for any services and request them to be provided under the relevant clause in the act.

I would be grateful if you could confirm in writing that you have received this request, and I look forward to hearing from you within the statutory time period.

Dear Elizabeth

I have made some enquiries with Consumer Affairs Victoria (CAV) in
relation to your request below.  CAV advise as follows;

"The FOI request asks for details from the Owners Corporation Register
pursuant to Part 9 of the act.

Part 9, section 147 outlines the requirement for the applicant at
registration of a sub division to create an Owners Corporation and
establish an Owners Corporation Register.  The maintenance of this
register is the obligation of the Owners Corporation created at that time.

Section 150 provides information concerning individuals entitled to
inspect this register and the regulations outline the prescribed fee.   As
each register is held by an individual Owners Corporation, it would not be
subject to FOI provisions.  Under the legislation access is limited to
"... a lot owner, a mortgagee of a lot or a purchaser of a lot or the
representative of a lot owner or a mortgagee or a purchaser of a lot, ..."
.  

With respect to the material requested, CAV does have a Register of Owners
Corporation Managers, that is published on its website

This information is freely available and the public can access the
following categories of information.  The information can be copied into a
spread sheet for further analysis if required.
 
 

In relation to information on individual lots,  CAV does not collect this
information. "

Thank you for the response, but it seems things have gone full circle.

You will see that I originally approached the Department of Environment, Land, Water and Planning (https://delwp.vic.gov.au/), appealing to provide a bulk download of the header level detail of their "Owners Corporations Search Report (Premium)" within LANDATA REGD TM. However, they referred me to your area despite the knowledge i had gained that indicated a report could be provided on an individual property.

Thank you for the response, but it seems things have gone full circle.

You will see that I originally approached the Department of Environment,
