Past amendments to Turrella's roll-out schedule

Mario made this Freedom of Information request to NBN Co Limited

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

The request was refused by NBN Co Limited.

Dear NBN Co Limited,

I'm writing to you requesting documents that show nbnCo's previously published 'ready-for-service' dates, 'cease-sale' dates and 'planned delivery technology' roll-outs for brownfield premises covering the suburb of Turrella (postcode 2205).

For the purpose of this request 'brownfields' refers to existing lots/houses/developments that were already established during the course of the roll-out.

I am requesting:
- Documents showing the expected ready-to-service dates for the suburb of Turrella (postcode 2205) as published by nbnCo in the years 2013, 2014, 2015, 2016, 2017.

- Documents showing the expected copper cease-sale dates for the suburb of Turrella (postcode 2205) as published by nbnCo in the years 2013, 2014, 2015, 2016, 2017.

- Documents showing the expected delivery technology for the suburb of Turrella (postcode 2205) as published by nbnCo in the years 2013, 2014, 2015, 2016, 2017 {i.e. HFC, FTTN, FTTP FTTdp, FTTB, FTTC}.

Should it be difficult to find these particulars for the broader suburb of Turrella I ask that for the purposes of this request the retrieved information cover the appropriate dates and facts for the geographical area spanning Walker St, in the suburb of Turrella (however excluding the corner of Walker St and Turrella St).

I'd like to thank-you in advance for your assistance.

Yours faithfully,
Mario

Dear Kate,

Thanks once again for taking the time to look at this request.
In pursuit of clarifying this request further I'm more than happy to further limit the scope of the documents I'm after in order to assist nbn in locating them.

Geographical Area
In the "Scope of Request and Notice" section of your response you have mentioned that the geographical area for Walker St could still encompass a broad range of documents. For the purpose of this request I'm happy to take number 28 Walker St to serve as the focus of the document search should that aid nbn in responding to this request.

Alternatively, nbn is more than welcome to use any address alongside Walker St (however excluding number 49 Walker St or 56 Walker St) for the purposes of this FOI request and redact the chosen address at the time of disclosure.

Exemptions under the Commercial Activities Carve-Out
In your response you have mentioned that while you have not reviewed any documents there may be a possibility certain documents falling under this request would be exempt from release under Section section 7(3A) or Part II of Schedule 2 of the FOI Act.

As a sign of good-faith I would like to further narrow the scope of this request to only include the 'ready-for-service' dates and the 'planned delivery technology' for the years outlined in my original request. Please ignore, 'cease-sale' dates from my original request.

For the avoidance of doubt this request is not seeking operational information regarding nbn's roll-out, only the specific information requested regarding Turrella's previous roll-out expectations.

Document Search & Resources
I trust all this information has previously been made available to the nbn department responsible for updating and maintaining the nbn website which regularly publicly releases and modifies this information on it's online roll-out map.

I assume, although cannot obviously be certain, that looking for these particulars amongst those documents with the nbn website team might be a good place to start and also support the finding of these particulars in a format that is least likely to produce a commercial conflict and lessen the burden on nbn's resources.

I'd like to thank-you again for your continued assistance and acknowledge the effort and scrutiny required in fulfilling these requests.

Yours sincerely,
Mario

Dear Kate,

Thank-you again for your correspondence regarding this request. I am unfortunately unable to provide identity documents or links to the subject property at the specific address at 28 Walker St.

Please note that the spirit of the original request is to ascertain Turrella's previous roll-out of expectations. The FOI Act does not require me to identify myself for requests not related to personal information.

I suggest that we return to the original request encompassing the broader area of Walker St.

Alternatively you are more than welcome to pick any address in Turrella for the purpose of this request and redact or de-identify any personal information linked to your chosen address so long as the address you pick is part of the 'brownfields' list of premises and has not yet been listed as 'ready-for-service'.

With Turrella's population at well over 2,500 and more than 800 dwellings in the area (2016 Census QuickStats, Australian Bureau of Statistics) this should be more than sufficient to alleviate any privacy concerns, facilitate additional opportunities to swiftly locate qualifying documents and keep the disclosure of this request available to the public.

Please let me know if there is any legal reason that does not make this possible. Thank-you again for your continued assistance surrounding this request.

Yours sincerely,

Mario

Mostly I classify a response like this one to say "clarification requested" because the agency has told the applicant that some more information (or money!) is needed before the request will be processed. This time, I have put the response in the category of "refused" because it is more several months since the agency responded and the applicant has not made a follow-up. This does not mean that the agency will refuse the request when an application is made in the correct (required).
