Dear Juliana Walsh,

Noting the 13 September 2019 legislated deadline to reply I am writing to see when the ABC will respond? It appears a quite straight forward request and shouldnt cause any undue delay.

Yours sincerely,

P Johns

Dear P Johns

FOI REQUEST – REFERENCE NUMBER ABC FOI 201920-011

I refer to your request for access to documents under the Freedom of
Information Act 1982 (the FOI Act).

I have taken reasonable steps to identify and retrieve all documents
relevant to your request, and as a result of those searches, one document
has been sent to us for assessment.

In my view, that document contains information about a person or persons
who might reasonably wish to make a contention that the documents are
conditionally exempt under section 47F (personal privacy) or 47G (business
information) of the FOI Act, and that access to that document would, on
balance, be contrary to the public interest for the purposes of section
11A(5).

In those circumstances, I am required to give the relevant individual or
individuals a reasonable opportunity to make submissions in support of
such a contention, and to have regard to any submissions that are made.

The ABC was to have made a decision in this matter by 13 September 2019.
In accordance with section 15(6) of the FOI Act, the period of time to
notify you of a decision is extended by a further period of 30 days to
enable that consultation to occur. This means that, subject to any
suspension of the processing period or further extension of the time for
deciding this application, the ABC is required to make a determination in
relation to this application by 14 October 2019.

We will endeavour to have a decision in the matter to you as soon as
possible.

Kind regards
Juliana

Dear P Johns

Attached is the ABC’s decision in the matter FOI 201920-011, and the
document that has been released to you.

My sincere apologies for the delay in our response on this matter, which
is reflective of general delays the ABC is experiencing at the moment in
FOI processes due to an influx of requests, some large and/or complex, and
limited resourcing in this area.

Your patience is appreciated.

Kind regards

Juliana
