Dear Deakin University,

Reference:
A. News law created from a precedent Defamation case https://news.google.com/articles/CAIiEKu...

I have been made aware that a Facebook Page has been created by a person associated with your university alleging that I was the author of a number of emails. Since I only have a copy of emails I personally sent I’m now curious as to who was purporting to be me, so I can hand the all edged emails (if they appear to be forgeries using my name) to Facebook lawyers to seek that the Facebook Page that is allegedly defaming me, is removed?

I therefore request a FOI copy of all documents alleged to have been sent and released by Deakin University to any person do I can ask Facebook to remove a defamatory Facebook page online for the past 7 years where posts about me are viewed and shared. The Facebook page administrator campaigned in 2017 ( using an alleged pseudonym of “ Mary Martin” and allegedly sent Facebook messages to my previous employer a Federal Senator’s Facebook page which was managed by his media staff claiming that I am not an ADF rape victim - which is I am confirmed as being by the ADF.

I do not know (redacted) and I’ve only become aware of a 7 year campaign using a Facebook page to harass me online. Can Deakin University please release to me all the documents Deakin University has previously released to Lisa Hay so I can take the alleged material to a lawyer and obtain proper legal advice.

I would also like to be provided with any Deakin University correspondence and any internal investigation conducted by Deakin University that confirmed I was the author of the correspondence it allegedly has released.

Yours faithfully,

Mary-Ann MARTINEK

There is a defamation case in Victoria which referred to Facebook pages. Part of the defence was that a Facebook page must be searched for as some are hard to find. It was a defamation case between two RMIT academics and the lesser academic ( the one sacked) successfully had a reverse AVO placed on the senior lecturer bc his lawyers proved she had to go to considerable lengths to locate the Facebook page itself - I can not view the Facebook page other than see my name comes up associated with it on Google searches. .

Facebook allows page administrators to Block the person the page defames so the ordinary person can’t locate the defamatory page themselves.

The page that defames me is not visible to me, therefore I have to hand this matter to a lawyer to follow up.

Dear Deakin University,

I am writing to request an acknowledgement of my FOI request. I am intending to make a submission to a Royal commission into ADF and DVA veteran suicides snd the response from your university that may confirm a person “pretended to be me” wrote to your University and that correspondence may not have been vetted or confirmed with me as to whether I sent it?

There are new laws coming in relation to persons who create accounts in the names of their victims, and then use that material to harass “their victims” online.

I have made this request private for 12 months.

Yours faithfully,

Mary-Ann MARTINEK
