Your Freedom of Information request – consultation  

 

I refer to your request to the National Library of Australia dated 30
September 2022 for access under the Freedom of Information Act 1982 (Cth)
(FOI Act) to the following documents: 

 

 a. Number of requests made under 195CC of the Copyright Act 1968 since
2015  
 b. Copies of requests made under 195CC of the Copyright Act 1968 since
2015  

 

Practical refusal 

Due to the amount of work involved for the Library, under sections
24AA(1)(a)(i) and 24 of the FOI Act, the Library intends to refuse your
FOI request as a 'practical refusal reason' exists. Under the FOI Act, the
practical refusal reason is that processing your request 'would
substantially and unreasonably divert the resources' of the Library.  

We note that the Library has previously contacted you to discuss the scope
of your request. 

Preliminary searches indicate that there are over a billion requests that
have been made under s195CC of the Copyright Act during the relevant
period. It would take a significant number of hours to process your
request, including considering whether third parties need to be consulted
or any information (such as, personal information) needs to be redacted. 

If you decide not to make any revisions to your request, the Library may
refuse your FOI request as a ‘practical refusal reason’ exists. 

 

The Library is prepared to provide you with administrative access to the
‘Number of requests made under 195CC of the Copyright Act 1968 since
2015’. This will involve the Library collating some data for you. You will
need to withdraw your FOI request and advise us whether you would like
this information. 

 

How to send us a ‘revised request’ 

 

Before a final decision is made on your request, you can submit a revised
request. 

 

Within the next 14 days (consultation period) you must do one of the
following in writing: 

 

o withdraw the request; 

  

o make a revised request; or 

  

o tell us that you do not want to revise your request. 

 

If you would like to make a revised request, you might consider requesting
documents within a short period and requesting specific documents or types
of documents rather than asking for “copies of all requests”. 

 

If you do not contact us during the consultation period, your request will
be deemed withdrawn.
