Supplementary submission to primary FOI request
Dear OPC,
I supplement yesterday's FOI request by addresses legal professional privilege (LPP) under s42 for the requested documents.
AusAID’s disclosure of Attachment 2 and 3 and related material to me in 2012, during my collaboration as a named applicant, waives LPP for shared documents. AusAID and PM&C, as joint clients in the HOSM amendment process shared a common interest. FOI Guidelines note that disclosure to a limited audience with a mutual interest may not waive privilege, but conversely disclosure to an external stakeholder like me, a non-client veteran applicant, is inconsistent with confidentiality. Bennett v Chief Executive Officer, Australian Customs Service [2004] FCAFC 237 holds that disclosure by one joint client waives privilege for all “Where documents are shared between joint clients with a common interest, one client’s disclosure can waive privilege for all”). Ampolex Ltd v Perpetual Trustee Co (Canberra) Ltd [1996] NSWSC 7 confirms that a co-client’s disclosure to an external party destroys privilege “Privilege is lost if one party to a joint privilege acts inconsistently with its maintenance). AusAID’s intentional disclosure to me binds PM&C, negating their LPP claim.
Attachment 1: Letter to the Governor-General
Nature: A recommendation to extend the ‘Iraq’ clasp to Control Risks Group (CRG) employees. PM&C claims they do not hold it.
LPP Applicability: LPP appears unlikely as the letter’s purpose is administrative, not legal advice. Esso Australia Resources Ltd v Commissioner for Taxation (1999) 201 CLR 49 requires a dominant legal purpose “The privilege protects communications made for the dominant purpose of obtaining or providing legal advice”. Waterford v Commonwealth (1987) 163 CLR 54 excludes administrative communications “The privilege does not extend to communications that are merely administrative”.
Waiver: AusAID’s 2012 disclosure to me, including Attachment 3 (naming me) and related material (e.g., draft declaration details), waives LPP. As a collaborator, I was a stakeholder with a common interest. Mullen and Chief Executive Officer, Australian Electoral Commission [2018] AATA 3660 confirms waiver by disclosure to such parties “Privilege may be waived by conduct inconsistent with the maintenance of confidentiality”). AusAID’s sharing of Attachment 2 and 3 with PM&C and me suggests joint client waiver (Bennett v Chief Executive Officer, Australian Customs Service [2004] FCAFC 237 “Where documents are shared between joint clients with a common interest, one client’s disclosure can waive privilege for all”).
Attachment 2: Proposed Humanitarian Overseas Service Medal (Iraq) Declaration 2011
Nature: A draft legislative instrument.
LPP Applicability: LPP appears unlikely as the draft’s purpose is legislative, not legal advice, despite legal officer involvement. Waterford (above) limits LPP to explicitly legal communications. AWB Ltd v Cole (No 5) [2006] FCA 1234 requires legal advice as the dominant purpose (para [44]: “A document may be privileged if it contains legal advice as its dominant purpose, even if it serves other functions”).
Waiver: AusAID’s disclosure of Attachment 2 and 3 and related material to me, as a named collaborator appears to waive LPP in accordance with FOI Guidelines and case law.
Attachment 3: Letter from Director-General of AusAID
Nature: Attachment 3, a policy endorsement naming me, was disclosed to me by AusAID in 2010. Its administrative nature mirrors Attachments 1 and 2, reinforcing that none are privileged. Its disclosure to me and PM&C, and AusAID’s sharing of related material during my collaboration, establishes waiver for all related documents, as AusAID treated them as non-confidential.
Public Interest Disclosure serves transparency in veteran recognition and proper administration of the HOSM program. Disclosure allows members of a HOSM eligible contingent to unequivocally demonstrate that decision makers in PM&C have denied their rights to procedural fairness. Re Chandra and Minister for Immigration and Ethnic Affairs [1984] AATA 437 supports this “The public interest lies in ensuring that government processes are open to scrutiny”.
Please do not apply s22 to redact any material in the requested documents and I can confirm that all material in every document is relevant to my request.

Timeframe for receiving your decision and request for extension of time
The 30 day statutory period for processing your request commenced from the
day after your request was received by OPC. A decision is therefore due by
29 May 2025.
We note the transfer of the request has taken place during the original
processing time, and to allow sufficient time for the Department to search
and identify the file referenced for any relevant documents we seek your
agreement to a 14 day extension under section 15AA of the FOI Act. This
would change the decision due date to 12 June 2025.
Please confirm your agreement to the extension of time by replying to this
email by 20 May 2025.
Charges
Agencies may decide that an applicant is liable to pay a charge in respect
of a request for access to documents. If the Department decides that you
are liable to pay a charge, we will send you a preliminary assessment of
the charge as soon as possible.
