For your information, the two instruments are available for public
download on the [1]Federal Register of Legislation.  The first instrument
is owned by Finance and the second is owned by Treasury:

The only difference between the original signed copies and the version on
the Federal Register of Legislation is the signatures.

 

We note that Finance has adopted a policy to generally exclude from any
documents released under FOI, signatures and mobile phone numbers from any
documents released under FOI (unless publicly available). Therefore, the
likely version released under FOI would be the same as that available on
the Federal Register of Legislation.

 

Therefore, we ask that you withdraw your request from Finance.

The reason provided by Finance is that documents containing signatures will necessarily and automatically have signatures redacted if provided. This does not appear to be a policy or practice uniformly applied by Commonwealth departments and offices for FOI requests.

A decision has not been made in relation to your request. The previous
email was advising of Finance’s policy, providing you with the publicly
available information and inviting you to withdraw. You are able to
proceed with your request as worded, and a Finance delegate will make a
decision on your request.  

 

Can you please confirm that you would like to proceed to a formal
decision?

Can you please also advise if you agree to withdraw the Superannuation
instrument part from your request? Finance advises that the signed copy of
this instrument is likely held by the Department of the Treasury
(Treasury). The Federal Register of Legislation [1]Superannuation Industry
(Supervision) Amendment (Your Future, Your Super—Addressing
Underperformance in Superannuation) Regulations 2023 confirms that the
instrument is administered by both the Attorney-General’s Department and
Treasury (see the screenshot below). As such, it is likely that Finance
would not hold a signed copy of this instrument.

 

Therefore, we suggest that you withdraw this part of  your request from
Finance and make a separate request to Treasury, who can be contacted at

- Superannuation Industry (Supervision) Amendment (Your Future, Your Super—Addressing Underperformance in Superannuation) Regulations 2023.

On FOI officer's request for me to withdraw the whole request, regardless of whether you may have technical difference between requests to withdraw and refusal, it seem to be refusal in truth. But if Finance wants to make a formal decision first, then I will wait for Finance's formal decision on my request (except for the above instrument). I hope when Finance makes the formal decision, it will take into account the point made in my request for internal review.

On Monday 29 September 2025, Finance advised you that Finance would not
hold a signed copy of the [1]Superannuation Industry (Supervision)
Amendment (Your Future, Your Super—Addressing Underperformance in
Superannuation) Regulations 2023, given that it is administered by both
the Attorney-General’s Department and Treasury. Accordingly, you agreed to
withdraw the part of your request pertaining to the Superannuation
Industry (Supervision) Amendment (Your Future, Your Super—Addressing
Underperformance in Superannuation) Regulations 2023.

Finance will now process part of your request which pertains to the
following instrument:

o Electoral Legislation Amendment (Miscellaneous Measures) Regulations
2021

 

General FOI matters

Your request was received by Finance on 25 September 2025. The statutory
period for processing your request commences from the day after Finance
received your request and a decision is due on Monday 27 October 2025.

The processing period may be extended if we need to consult third parties,
impose a charge or for other reasons. We will advise you if this happens.

 

Liability to pay a charge

You will be notified of any charges in relation to your request as soon as
possible, before we process any requested documents or impose a final

Publication

As required by the FOI Act, any documents provided to you under the FOI

Policy to exclude junior officer contact details, signatures and mobile
phone numbers

Finance has adopted a policy to generally exclude from any documents
released under FOI, the names and contact details of junior staff (non-SES
officers) and staff employed under the Members of Parliament (Staff) Act
1984 (adviser level and below). Finance has also adopted a policy to
exclude signatures and mobile phone numbers from any documents released
under FOI (unless publicly available). Finance’s preference is to reach
agreement with FOI applicants to exclude these details from the scope of
the request. Where there is no objection, the names and contact details of
junior officers, as well as any signatures and mobile phone numbers
appearing in identified documents, will be redacted under section 22 of
the FOI Act on the basis that these details are irrelevant to the request.
