Timeframe for receiving your decision

The 30 day statutory period for processing your request commenced from the
day after the Department received your request, you should therefore
expect a decision from us by 30 October 2025.

The processing period of 30 days may be extended in certain circumstances
and we will write to you separately regarding any extension of time. 

Exclusion of non-SES staff names and contact details
It is the Department’s policy to delete from documents:

 

o Any person’s signature.
o Names and contact details of Australian Public Service officers who
are not Senior Executive Service (SES) officers.
o Mobile or direct numbers of SES officers.
o Names and contact details of Ministerial staff at a level below Chief
of Staff.

If you disagree with this policy and want access to this information
please let us know at [2][DPMC request email]. Otherwise this type of
information will be deleted as irrelevant under section 22 of the FOI Act.
SES officer details are considered within scope and release will be
considered in accordance with the FOI Act.

Charges

Agencies may decide that an applicant is liable to pay a charge in respect

are liable to pay a charge, we will send you a preliminary assessment of
the charge as soon as possible.

The current due date for a decision on your FOI request is 30 October
2025. Unfortunately, we are unable to make this timeframe. By way of a
progress update, we have finalised document searches and will shortly
commence preparation of a decision pack.

The Department would like to work with applicants in managing the
timeframes of its requests. The FOI Act has built-in provisions that
facilitate extensions in consultation with applicants, this enables
agencies to manage their FOI requests and keep them within time. Given
this, we seek your agreement to an extension of 21 days under section 15AA
of the FOI Act, this would extend the due date to 20 November 2025.

this extension by 24 October 2025.

I am writing to request an internal review of Department of the Prime Minister and Cabinet's handling of my FOI request 'Signed copy of legislative instruments', FOI Reference: FOI/2025/252.

My understanding of DPMC's email of 23 October 2025 is that my request is refused. However, different Commonwealth government departments or offices have been referring me to others (including DPMC) on my request(s), even if the instruments concerned may have been signed by their own department or office.

Anyway, can DPMC at least clarify or advise if the fact is that DPMC simply does not have possession of the information requested? If however DPMC does have possession of the information requested or at least some of this information, then my request is for the information requested which is in the possession of DPMC.
