Dear Deakin University,

I seek access to the following documents under the Freedom
of Information Act 1982:

1. Current social media policy of the University, and or the department, which covers
departmental use and/or private use by employees in an individual
capacity.

2. Current social media policy of the use of University, and or the department, which covers University/ departmental use and/or private use of University email addresses by employees in an individual capacity.

3. Any current guidance material which is available for employees to make informed decisions about their private social media use.

You cannot legitimately ask for an internal review. The reason for this is because your initial request was not valid. You are correct to say that your application was under the Freedom of Information Act 1982, but it is the Freedom of Information Act 1982 (Vic) that is relevant, not the Commonwealth Freedom of Information Act 1982. There are important differences. Section 17(2A) of the Victorian Act says "(2A) A request must be accompanied by a fee of 2 fee units". If you do not pay the fee, the request is not valid so the rights of review do not have effect. There is an exception that allows the fee to be waived but the waiver must be requested. If you want to ask for a waiver it is best first to telephone the agency and ask what details they would need.

To solve your problem, may I suggest that you telephone the FOI officer of Deakin University (have a look here http://foicommissioner.vic.gov.au/agency... ). The officer might be able to explain how you can pay the fee, perhaps over the telephone with a credit card or by to send a cheque. If you get a receipt number, you can then use this exact Right to Know webpage to relodge your request and you can say "I have paid the FOI fee; receipt number 012324535".

To add to the note above, the Vic FOI Act no longer includes internal reviews. Therefore the next step in the process would be to request a review by the FOI Commissioner. Given the request is not yet a valid request, I would also suggest following up with the FOI officer in the first instance, particularly if the info you're after isn't contained in the deakin uni policy library.
