Dear Department of Immigration and Border Protection,

I would like to undertake a research in to potential abuse of Partner immigration visa by spouses of Australian permanent residents and citizens. I have see a number of cases where overseas citizens have married an Australian resident purely for the purpose of residency and once they get here they have exploited a number of loop holes in our immigration system. One of the loop holes I have seen is most of them claim that they have been a victim of domestic violence and since it is a severe case visas are granted in almost all cases without proper investigation.

Yours faithfully,
Research in to Visa abuse

Good morning researcher

Thank you for your email dated 29 September 2016 below, in which you have indicated you would like to undertake research into potential abuse of Partner immigration visa by spouses of Australian permanent residents and citizens.

I note that your request is not currently a valid request for the purposes of the Freedom of Information Act 1982 (FOI Act), as it does not comply with the requirements of section 15(2)(b). In order for a request to be valid for the purposes of the FOI Act an applicant must provide such information concerning the document being requested as is reasonably necessary to enable a responsible officer of the agency to identify it.

In addition, your request must also not result in a substantial and unreasonable diversion of the resources of this agency from its other operations.  I note that in the subject line of your email you have indicated you are seeking statistics across a 10 year period. If the Department does not record the data in a form that can be easily reported on through its computer systems, it would be necessary to manually review every permanent residency awarded across that 10 year period to identify which cases are relevant to your request.

If you have not already done so, you may wish to refer, in the first instance, to the Department's Annual Reports, which can be found here:
http://www.border.gov.au/about/reports-p...

As your request is currently not valid for the purposes of the FOI Act, the Department is unable to proceed with it at the present time.

If you wish to reconsider the scope of your request, and resubmit a valid request, the Department can consider whether it holds any documents relevant to your request, and whether your request can be processed.

If you require any further assistance, please do not hesitate to contact the FOI Section at [email address].

With kind regards
