I request access to the following document under the Freedom of Information Act 1982:

The current template or pro forma version of the "deed of undertaking" (or any similarly titled document) that personnel engaged by outsourced service providers, such as Probe Operations Pty Ltd (ABN 94 624 615 925), are required to sign directly with the Australian Taxation Office as a condition of their engagement.

I am seeking the version of this document that has been in use from 1 July 2024 to the date of this request.

To assist in the timely processing of my request, I wish to provide a clarification.

The document I am seeking is the pro forma or template version of the "Deed of Undertaking" (or similarly titled document).

I am seeking the blank, standard document that personnel are required to sign, not a completed or executed deed from any specific individual or external provider(s).

While my original request mentioned Probe Operations Pty Ltd as an example of the type of service provider whose personnel would sign such a deed, the template document itself is generic and would not contain any specific commercial-in-confidence or personal information related to that company.

Given that the document requested is a standard, blank administrative template, I ask that the request be processed on the basis that third-party consultation is not required.

I hope this clarification is helpful and allows for a decision to be made within the original statutory timeframe.

I am requesting an internal review of the decision issued on 21 November 2025 in FOI-2025-01089.

The decision does not provide the document responsive to the scope of my request.

Despite my clarifications on 6 November 2025, the ATO released the supplier Deed Poll rather than the employee-level Deed of Undertaking that individual personnel engaged by outsourced service providers are required to sign as a condition of performing ATO Service Delivery work.

My request expressly sought the template or pro forma Deed of Undertaking for external personnel, not a deed executed by companies. These are different documents with different purposes, and only the former falls within scope.

The ATO also requires this document for all external personnel engaged under the SPC-6894 Outsourced Service Delivery Panel, which includes Probe, Serco and Concentrix. As a panel-wide, standardised employee document, it is not commercially unique to any one provider and can be released without affecting any company’s proprietary information.

The decision has therefore not identified, assessed or released the correct document.

I request that the internal review:
1. Reinterpret the scope correctly as applying to the employee-level External Personnel’s Undertaking.
2. Conduct a renewed search for the correct template document used for all SPC-6894 personnel.
3. Release the responsive document in full.
