Dear Department of Health,

A representative of your Department recently advised that your relevant Standing Committee plans to issue (in 2018) a revision to it's 2016 Position Statement on Breast Density and Screening.

Please provide the following information:

1. A copy of the official Terms of Reference for that review.

2. The name(s) of the organisation and/or person(s) who is/are conducting that review for the Standing Committee.

3. The date by which the review team is planned to present the draft revision of the Position Statement to the Standing Committee for it's consideration.

4. Contact details for members of the community to provide input to that review in accordance with BreastScreen Australia’s stated policy ‘BreastScreen Australia supports greater discussion, public awareness and research into breast density.’ By ‘community’ I mean individuals such as myself and organisations that are not reliant on government funding and support (i.e. independent).

Dear Mr Shephard,

 

I refer to your request to the Department of Health seeking access under
the Freedom of Information Act 1982 (FOI Act) to:

 

            ‘1. A copy of the official Terms of Reference for the review
of the Breast Density and Screening 2016 Position Statement;

2. The name(s) of the organisation and/or person(s) who is/are conducting
that review for the Standing Committee;

3. The date by which the review team is planned to present the draft
revision of the Position Statement to the Standing Committee for its
consideration; and

4. Contact details for members to provide input into the review.’

 

Notice of Third Party Consultation

 

It appears, from the documents to which you seek access, that a third
party may reasonably wish to make a contention concerning possible
exemption of some of the documents. Accordingly, the Director – Freedom of
Information, an officer authorised under section 23(1) of the FOI Act to
make decisions in relation to freedom of information requests, has
determined that the requirements of section 27 make it appropriate to
extend the time frame for dealing with your request.

 

Pursuant to section 15(6) of the FOI Act, the period for providing you
with a decision has been extended by a further period of 30 days. This
means that the Department must, not later than 60 calendar days after the
day on which your request was received, take all reasonable steps to
notify you of a decision on your request.

 

Scope of request

 

The right of access under the FOI Act is to existing documents held by an
agency, not information. Dot points 2-4 of your request is for
information, not documents held by the Department.

 

However, the FOI Unit has been advised by the relevant line area that
correspondence is currently being drafted to respond to your letter to the
Department. In this response, the Department will provide you with the
information you are seeking in dot points 2-4.

 

Could you please confirm, by COB Friday, 9 March 2018 if you agree to have
dot points 2-4 of your request addressed in the Departmental response? If
the FOI Unit does not receive a response by this time, your request will
continue to be processed in full.

 

Relevant provisions

 

The FOI Act, including the provisions referred to in this email, can be
accessed from the Federal Register of Legislation website.
