I refer to your email below  received by the NDIS Quality and Safeguards
Commission (the NDIS Commission) on 15 April 2021, in which you requested
access, under the Commonwealth Freedom of Information Act 1982 (FOI Act)
to the following information:

“I would like to know;

- how many disability service providers who are NOT participants have been
charged by the police for fraud or other finance related crime

- how many disability service providers who are NOT participants have
faced regulatory action from your agency for fraud or other finance
related crime

- how many disability service providers who are NOT participants have been
charged by the police for other crimes which do not involve finance
related crimes but abuse relating to violence, abuse or neglect or
restrictive practices

- how many disability service providers who are NOT participants have
faced regulatory action for other crimes which do not involve finance
related crimes but abuse relating to violence, abuse or neglect or
restrictive practices

- how many disability service providers who ARE participants have been
charged by the police for fraud or other finance related crime

- how many disability service providers who ARE participants have faced
regulatory action from your agency for fraud or other finance related
crime

- how many disability service providers who ARE participants have been
charged by the police for other crimes which do not involve finance
related crimes but abuse relating to violence, abuse or neglect or
restrictive practices

- how many disability service providers who ARE participants have faced
regulatory action for other crimes which do not involve finance related
crimes but abuse relating to violence, abuse or neglect or restrictive

- of the above, what proportion of persons were registered providers of
services and what proportion were unregistered

- how many participants have been charged by the police for fraud or other
finance related crime

- how many participants have faced regulatory action from your agency for
fraud or other finance related crime

- how many participants have been charged by the police for other crimes
which do not involve finance related crimes but abuse relating to
violence, abuse or neglect or restrictive practices

- how many participants have faced regulatory action for other crimes
which do not involve finance related crimes but abuse relating to
violence, abuse or neglect or restrictive practices

- of the above, how many were self managing their funding

- how many complaints you have received about alleged wrongdoing by
disability service providers 

- how many complaints you have received about alleged wrongdoing by
participants”

Timing

The statutory period for processing your request is 30 days commencing
from the day after we received your request. Accordingly, the deadline for
notifying you of the NDIS Commission’s decision on access is 15 May 2021.
I note that 15 May 2021 is a Saturday. In accordance with the FOI
guidelines issued by the Australian Information Commissioner, if the last
day for notifying a decision falls on a Saturday, Sunday or a public
holiday, the timeframe will expire on the first business day following
that day. As such, the due date for our decision on your request for
access is 17 May. The period of time to decide your request may be
extended if we need to consult third parties or for other reasons. We will
advise you if this happens. 

Charging

You will be notified as soon as possible if a charge is associated with
processing your request.

Disclosure log

Information released by the NDIS Commission under the FOI Act is required
to be published on the FOI disclosure log on our website, and made
publicly available, unless certain exceptions apply. For example, personal
or business information will not be published where this would be
unreasonable.  Your views are sought as to whether the information should
be placed on the disclosure log.
