Dear Australian Prudential Regulation Authority,

On 1 July 2016 a purported "successor fund transfer" occurred where PFS Nominees Pty Ltd was the Transferer Trustee and NULIS Nominees (Australia) Ltd was the Transferee Trustee.

PFS Nominees Pty Ltd was the trustee of:

(i) National Australia Bank Group Superannuation Fund A;

(ii) BHP Billiton Superannuation Fund;

(iii) Worsley Alumina Superannuation Fund

NULIS Nominees (Australia) Ltd was and is the trustee of the MLC Super Fund.

The document (or documents) I seek is a copy of any correspondence from PFS Nominees Pty Ltd, or NULIS Nominees Australia Ltd (or from National Australia Bank or any other NAB subsidiary company) advising APRA that Nicole Susan Smith (who testified at the Hayne Royal Commission) was the Chairman of both PFS Nominees Pty Ltd and NULIS Nominees (Australia) Ltd and that all the other Directors were the same.

The search period is from 1 January 2016 to 30 June 2016.

Dear Mr Sweeney,

APRA seeks your agreement to extend the timeframe by 20 days to process
the below request under s 15AA(a) of the FOI Act. APRA is due to make a
decision on your request by 18 December 2020 but requires an extension of
time to undertake further consultations and reviews and would appreciate
your agreement to extend the time for processing it. Should you agree to
the requested 20 day extension, APRA will be required to make a decision
on your request by 7 January 2021.

Please advise in writing if you consent to this extension of time.
