Good morning Ray,

 

Acknowledgement and notification of third party consultation – FOI 22-020
– Documents relating to Woolgoolga Whale Trail

 

I refer to your request received on 8 August 2021 by the Department of
Infrastructure, Transport, Regional Development and Commutations (the
department) seeking access to:

 

all details you have with Coffs Harbour City Council concerning the
financing of and the proposed design of a Whale Trail to be located at
Woolgoolga NS.

 

While processing your request, the department has identified documents
containing the business and/or personal information of a person,
organisation or undertaking. In accordance with the FOI Act we are
required to consult with relevant third parties before making a decision
on the release of documents.

 

As such, please be advised that the processing time limit for your request
has been extended by 30 days in accordance with subsection 15(6) of the
FOI Act. The revised due date for a decision on access is on or before 7
October 2021.

Dear Ray

The Department provided you with an internal review decision (in which you were provided further information) on 10 November 2021.

There is no option in the FOI Act to conduct an internal review of an internal review decision. You will need to lodge a request with the Information Commissioner (OAIC) if you want that decision reviewed.

We note in relation to the email you refer to below (doc 3) that the Coffs Harbour City Council passed the resolution at a public Council meeting (as noted) in July 2021 and were working towards determining an appropriate course of action to address the resolution.

The Coffs Harbour City Council are a separate entity to the Department and you may wish to direct your enquiry as to the progress of the resolution to the Council.
