We refer to your correspondence of 16 September 2025 seeking access, to
documents held by the Australian Charities and Not-for-profits Commission
(ACNC), under the Freedom of Information Act 1982 (FOI Act).
We have taken your request to be for copies of complaints, dated 7 October
2023 through to 16 September 2025, against registered charities for
promoting or encouraging the war in Gaza.
Please consider this email to be acknowledgement of your request for the

Commission Act 2012 (Cth) (ACNC Act) outline strict secrecy provisions.
Due to the operation of these provisions we can usually only disclose the
information the ACNC obtains about a specific entity to that entity’s

and the FOI Act does not override these provisions.
It is your right to continue with this FOI request. However, because of

with any documents which the ACNC may hold within the scope of your
request.
If you would like to discuss the effect of Division 150 of the ACNC Act on
your request in further detail, please let us know. Alternatively, please

impose a final charge.
Please note that information released under the FOI Act may later be
published online on our [1]FOI Disclosure Log. Some information, including
personal information, will usually not be published.
We will contact you using the email address you provided, unless you

Dear Applicant,
The operation of Division 150 of the ACNC Act means that it is an offence
for an ACNC officer to disclose information that relates to the affairs of
any specific charity – or any charity which the information is reasonably
capable of identifying – to a member of the public, apart from information
that is published on the [1]Charity Register.
Any request under the FOI Act for documents relating to ACNC
investigations is likely to be impacted by Division 150 of the ACNC Act.
Furthermore, documents relating to investigations may be exempt from
disclosure under the FOI Act pursuant to section 37 of that legislation.
Yours sincerely,
ACNC FOI Team
