The applicant was a little enthusiastic to ask for a rapid confirmation of receipt by the Australian Broadcasting Commission of the applicant's request. According to s 15(5)(a), the agency should send an acknowledgement "as soon as practicable but in any case not later than 14 days after the day on which the request is received . . . ". Now that we know the request has been received, we also know that a response was calculated to be due on Saturday, 15 April 2017. However, because of s 36(2)(b) of the Acts Interpretation Act (http://www.austlii.edu.au/au/legis/cth/c... ) the agency does not have to give a response on a public holiday or weekend but is permitted until the next day that is not a weekend or public holiday. If Easter Tuesday is a public holiday in the place where the agency is has its office, then the due date is Wednesday, 19 April 2017; otherwise it is Easter Tuesday, 18 April 2017.

I do not know where the Australian Broadcasting Commission exists but Time and Date (https://www.timeanddate.com/holidays/aus... ) tells me that Easter Tuesday is a holiday exclusively in the State of Tasmania.

The ABC is based in NSW (their Head office is in Ultimo). This would make the due date close of business on Tuesday.

Dear Juliana Walsh,

I note that it appears, by my calculation, that the response to this FOI is overdue. Just inquiring as to its progress?

Yours sincerely,

UD
