3. any technical specifications or requirements issued by the ATO in relation to the tender or contract

Dear FOI,

I seek an internal review of the decision 1-LK5B4EE.

There may indeed have not been an open tender, but I asked for:

2. the contract awarded to BCG (please provide a copy)
3. any technical specifications or requirements issued by the ATO in relation to the tender or contract.”

and neither of those documents I requested within the scope of my FOI request, were conditional upon those documents being procured through open tender.

Please provide those documents through FOI.

Frankly, I don't care if you or your department regards those documents as 'confidential' or not, please evaluate whether or not you are able to release those documents to me under the decision making criteria specified in the freedom of information act.

Given the large sums involved, and the extremely limited information available about this contract on AusTender, it would clearly be in the public interest, (I would argue), to have the documents specified above released in the interests of expenditure oversight.
