Dear Department of Social Services,
I believe that two of my relatives are claiming or were claiming disability benefits , under fraudulent circumstances. Is it possible for me to find out so as I can inform Centrelink?

Dear Mr Bauer

Under section 11(1)(a) of the Freedom of Information Act 1982 (FOI Act), every person has a legally enforceable right to obtain access to documents (rather than information). However, under section 47F(1) of the FOI Act, documents are conditionally exempt if disclosure under the Act would involve the unreasonable disclosure of personal information about any other person. Therefore, information relating to other persons' receipt of disability benefits would almost certainly be exempt under the FOI Act.

However, if you suspect someone of committing fraud, you should report it in one of the following ways:

- by form (attached to this email); or
- by phone (call the fraud tipoff line on 131 524, Monday to Friday, 9:00 am to 4:45 pm AEST excluding South Australian public holidays).
