Dear Mr Smith

In response to your Freedom of Information request received on 16 February
2017, please find attached the formal response from the ABS.

(See attached file: FOI 201617-55 - Response.pdf)

In addition to the formal response from the ABS I would like to provide
the following information in regards to the Enterprise Agreement ballot
process:

o the ABS provides all staff with an opportunity to vote on proposed
enterprise agreements, including those staff on leave or otherwise not
attending the office. The process applied by the ABS complies with the
relevant provisions of the Fair Work Act 2009 (Cth) which obligate
organisations to provide staff with the opportunity to vote on
proposed enterprise agreements that affect their employment;
o the ABS procured the services of an external organisation to conduct
the Enterprise Agreement ballot process consistent with the
Commonwealth Procurement Rules;
o the external organisation responsible for conducting the ballot/s is
required, under the conditions of engagement, to protect all
information obtained during the ballot process and to destroy this
information at the completion of the process; and
o to support the Enterprise Agreement process the ABS collected only the
minimum information required to support the process and released
only aggregate information for each state and territory and the total
result for the organisation.

Should you have any questions regarding this please feel free to contact
the ABS FOI Contact Officer on: 02 6252 7203 or email:
