Please take this request for any documents that your department holds in relation to any "Exemptions" or "Wavers" as defined by the Webster Dictionary or socially accepted definitions of the words in the country of Australia to comply with any legislation that your office has powers, authority or manages under legislation for its management as a superannuation provider.

In order to assist processing your request:

1 Are you able to provide more detail about what exemptions or waivers might be operative with respect to this agency's dealings with the various superannuation schemes you list below?

2 Do you have in mind a specific statutory provision that relates to such an exemption or waiver in this context?

I should also add that AFSA is not a 'superannuation provider' in any sense that is generally recognised. As a Commonwealth agency our HR area would have a number of arrangements to facilitate payments to such schemes, either by virtue of voluntary payments or to ensure compliance with their duties as an employer in respect of the payment of statutorily mandated payment amounts.

To be honest and upfront I am expecting that our office provides an statement under the act saying no documents exist.

We are looking at and for documents from government departments in relation to how the CSC is run and exceptions they have been given to ignore, throw out or ignore rules or legislation.

As your department is only dealing with insolvencies and the like this request was out of an abundance of caution incase you have some power that could have been used in the L above.

To remove any confusion please remove the PSS from this request to your office. I am 99.99% sure that the amended scope will now result in an “no documents exist / can be found decision”
