Extension of time application by the National Disability Insurance Agency
Dear Mr Buckley
I write to advise that on 13 September 2021, the Office of the Australian
Information Commissioner (the OAIC) received an application from the
National Disability Insurance Agency (the NDIA) for an extension of time
to process your FOI request of 18 August 2021.
The NDIA has applied for an extension of time under s 15AB of the Freedom
of Information Act 1982 (Cth) because your request is considered to be
complex and voluminous.
· The NDIA has advised the OAIC that:
− on 10 September 2021, the NDIA sought your agreement to an extension
of time under s 15AA of the FOI Act. The NDIA advises that you responded
that ‘it makes no difference whether I agree or not’. The NDIA has taken
your response to indicate that you did not agree to the request.
− the FOI request is complex in nature and voluminous and seeks access
to a large number of documents
− the NDIA is conducting searches and consultations with staff to
identify all relevant documents within scope, and determine whether it
needs to further engage with you
− the information requested is highly likely to contain a number of
sensitivities and therefore requires additional time and consultation
during the decision making process.
− COVID-19 lockdowns have impacted on the NDIA’s agency operations,
and
− the NDIA will continue to liaise with you and provide you with a
decision as soon as possible.
The NDIA has requested an extension to 18 October 2021. I will take any
comments you may have to make into account when deciding the application.
Please respond to this email by close of business 17 September 2021. If
I do not hear from you by this date, I will proceed to make a decision on
the basis of the information provided to me by the NDIA.
You will be notified of the decision once the matter has been finalised.

Thanks for your letter.
The National Disability Insurance Agency (NDIA) keeps much of its business secret from the people who depend on it. It is important that people with disability know what the Agency tells its Minister since we feel some of the advice they provide misinterprets data and misrepresents our community and its representatives. We need to be aware of advice given to the Minister and the Government; we'd like to provide our side of the discussion.
Government gave us just 4 weeks to respond to proposed revision of NDIS legislation. This timeframe is completely inadequate, but we can't just give ourselves an extension, which is what the NDIA did in this matter.
As I indicated in my response to the NDIA, it makes no difference what I say - the NDIA took an extension and may still choose to decline my request, or limit access to information. We'll just wait and see what we get and when we get it.
